Senator Graham on Impeachment: “I Will Not Allow Hearsay Evidence During Senate Trial”…

An impeachment trial in the senate would presumably be run through the Senate Judiciary Committee (presiding judge John Roberts), unless there are constitutionally permitted process rule changes.

Senate Judiciary Chairman Lindsey Graham begins to get specific about what he will and will-not allow as part of the senate trial.   Graham notes the ‘hearsay rule’ will be applied to the House evidence within the article(s) as presented.  Additionally, Graham notes that anonymous witnesses (ie. “whistleblower”) will not be permitted.

    More importantly, there will be due process and representation of the accused. I assume key members of the administration would testify (as long as there is due process), which would take away the Dems’ phony arguments for the need of hearsay.

        It’s funny how this keeps happening. People are personally delivering docs to Trump and Barr.

        We also have Patrick Byrne from Overstock who said he was only coming forward recently because of Barr. He didn’t trust the former people in charge.

        Barr also had to travel to meet with people to personally to get docs.

        Looks like the criminal cabal days are numbered. They are being exposed globally.

            I certainly was not a fan of his Never Trump phase, and yes, he’s a mixed bag, but some of his recent work is excellent.

            Keep this in mind. I think nearly everyone here will agree that Sundance’s work exposing the coup is the best available. Having said that, I have several conservative friends that don’t have the patience to read the articles and supporting documents here.
            Putting some of this the video format with the blackboard has value.
            Even with all of the great info hear, I have a much better understanding of Ukraine after watching Beck.

        I’m suspicious. Erdogan has to know that any documentation he provides to POTUS will be considered by Pelosi and Schiff as a quid pro quo for pulling out of northern Syria and will be treated as an impeachable offense to be added to the running Bill of Attainder.

I discovered John Perkins and “Confessions of an Economic Hit Man” a number of years ago and it all made sense – falls into place once one understands their pattern and how they do it. Then you can look at current events and see what they are trying to accomplish. Turkey is just one of the targets.

        Here’s a short documentary and, if interested, there’s a book and audio book as well (for now, until YouTube takes it all down soon). Well worth the time to understand it.

        Essentially, there’s political interference, economic interference and if all that doesn’t work, they overthrow them. After discovering this, I realized they had just been practicing all over the world only to use their craft here at home – what we see now in the U.S.

          Just inside Wisconsin. We only had Twin Cities TV. I watched them when I was really little, trying to figure out what the guys on the side line were always fighting about. It was a joke and fun at the same time.

              My Grandfather was one of the most respected businessmen in the area. Level headed, very successful, went to church and helped out any number of people any way he could. You guessed it. About five minutes before his youngest daughter’s wedding they had to go get him and drag him away from the TV and throw him in the car! My cousins and I still laugh thinking about him sitting on the edge of the bed in his shorts watching the Crusher. It was totally out of character for him. I guess it was an outlet for stress. McConnell should have done this sooner but after today’s House testimony putting Schiff’s best witnesses first it’s obvious even to a RINO like McConnell that Schiff was turning the United States political system into a ridiculous circus complete with the clowns!

        I think this must go to the Senate for a trial. That is the point in which real witnesses can be heard and real testimony offered.

        What is happening in the House hearings is a sham, but a properly run trial (and I know what you’re thinking, properly run/current Senate may be an oxymoron) can expose much, much more.

        Makes one wonder why the Deepstate has allowed this to get to this point. Either they know the fix is in with the Senate Chamber, they have a bombshell they have yet to roll out or they are just blinded by TDS. I’d like to think the latter, but I am unwilling to concede the former.

        I agree it is a political hit job, and it aims to trow taint that affects the implementation of Trump foreign policy. In other words, this is an international political action, not just a US political action.
        Hopefully the gloablists pay a price as a result. would be great to have the oublic wise up to the fact that Congress is acting in globalist interests at the expense of the US.
        On Graham’s proclamation, it’s an empty threat. A sincere trier of fact will take information from reliable sources, even if hearsay. The issue with this impeachment isn’t the process, it’s the substance. There is justification to investigate Hunetr Biden/Burisma, and there is justification to investigate Ukraine involvement in US 2016 election. That’s the only relevant evidence to “clear up” whateever conditions and threats Trump asserted.
        While I’m thinking of it, Schiff assigns implied threat due to Trump’s position of power. The same implied threat due to poistion of power is true of utterances by US diplomat Yovanovitch, who demanded cetain investigations by Ukraine government be shut down.

Impeachment, however, is not even a legal proceeding, much less a criminal trial. It is a political proceeding. No one’s liberty is at stake; it is strictly about whether an official should be stripped of political authority — in the president’s case, of the executive power.

      Moreover, because the Constitution wholly vests the process of impeachment in the House, and the conduct of impeachment trials in the Senate, those chambers have plenary authority over the respective proceedings. No court has the power to tell the House or Senate what quantum of due process must be afforded to an official in an impeachment case. No one can make Congress apply the Sixth Amendment.

        I despise Mitch and don’t trust him AT ALL, but it has occurred to me that by saying that there will be a trial, he is undermining the Schiff show. Couple this with comments from Lindsay about hearsay not being allowed, and Jim Jordan assuring and Adam himself will be a witness, and the Dems would be wise to shut this down. The last thing they want is a legitimate trial where their corruption and deceit is exposed. In addition, it is very unpopular amongst the American people and will only get PT re-elected in a landslide.

        However, since recognition of hearsay is something that anyone and everyone recognizes as wrong, even those who only hear it on tv, SCOTUS Roberts would immediately look terrible in allowing it, especially after Graham said he is is not letting it happen. And Roberts would be acutely aware of it.

          People claim it is wrong, then use it all the time anyway, so people say one thing and do another.
          We rely on hearsay all the time, because generally speaking, the chain of information is fairly reliable.
          Hearsay is even allowed in court, there are many exceptions to the hearsay rule – not that any apply here, just that not all hearsay is considered too unreliable to allow into court.
          Another reason hearsay is deprecated in court is to control and limit the sources of evidence, essentially to “the best available” and to limit the sheer volume of evidence.
          All that said, a better approach to the admissibility of evidence is to name names of potential witnesses, and drill down to the best (most reliable, relevant to the issue) ones. In a trial, there are opposing versions of fact. We have very little of that in this case. This case is nearly all difference of opinion.
          In court, cases are analyzed as containing questions of law and questions of fact. Hearsay applies to questions of fact.
          The way I see it, the relevant fact questions are whether or not there was justification to investigate Biden’s role in Burisma, and whether or not there is justification to investigate Ukraine (not the government) involvement in 2016 election.
          The DEMs have assumed the conclusion – there is no justification to undertake either of those investigations.
          This is self serving. It asserts Biden is not guilty (without allowing that question to be investigated), and it asserts it is out of bounds to investigate Chalupa and company.
          Pure power play by crooked DEMs.

        I do believe that the Senate sets its own rules for an impeachment trial. The Chief Justice “merely” presides over the trial, and if the rules prohibit hearsay evidence, the Chief Justice should disallow it.

          In the past impeachments, this question was resolved by negotiating who would be allowed to testify. FRE principles sort of apply, but aren’t applied rigidly.
          I doubt either of the witnesses we saw yesterday would appear in a Senate trial.

        The Chief Justice presides, but the role is largely ceremonial. The powers and authority he is given for an impeachment trial are given by the Senate. The Senate has full authority to tell the Chief Justice what to do.

    IMO it is time MAGA supporters come together and sacrifice McConnell’s seat and vote Democrat for his seat ONLY in Nov 2020 to send a message and regain control of our party.

      The role of the Chief justice is simply to satisfy the Constitution. He is given no powers or authority by the Constitution. The powers and authority the CJ is given, will be given by the Senate. If they want to, they can tell him to just sit there and knit a sweater.

      3) Who told you about the phone call?

      They did this, in anticipation. What were the previous rules? It takes 2/3 majority to convict? Here they are, talking about changing tradition on impeachment rules in the House and what’s this bullcrap? It’s sedition. Why would they change the rules?     I’d like to know if the Senate Judiciary Committee will approve the usual resolution “accepting” (I forget the legal word of art) the House’s impeachment record if the latter denied the House Minority due process (calling their own witnesses without Schiff’s approval, cross-examination of witnesses without Schiff’s interruptions, etc.). Everything each House of Congress does is by vote of that House and, AFAIK, that includes evidentiary records prepared by the other House.

    Because if the Senate Judiciary Committee and then the Senate as a whole vote against the resolution “accepting” the House’s impeachment record, there won’t be any evidence in support of impeachment.

            I have the same question though on the DJT material(rnc) it states how the money is divided. It also states you can select where your money goes but no direction as to how.

            This deserves a real answer from someone with the background. I have continued to give small amounts through the DJT website but I am ready to max out (( for me max out) don’t get the excited rnc )). I would like Trump to have total control of my donation. The consequences of the Schitt Show should be to expose and emphasize the true amount of corruption that has been occurring all over the globe, and how much of it has been centered in or protected by America, and how much specifically involved the very same people who are driving this bus right now: Pelosi, Nadler, Schiff, Biden, Obama.

    It should also be obvious that there is no crime here. A Bill of Attainder is expressly forbidden, and this is all that this charade could ever produce. The President is a co-equal branch which does not serve at the pleasure of Congress. These principles were clearly understood by the people who wrote our Constitution, and incorporated into the document.

    Now, it may well be that House Democrats would vote for a piece of toilet paper if instructed to do so by Party Bosses … but, enough is enough.
