Fraud Continues – Nancy Pelosi Promises House Impeachment Subpoenas Will Not Have Legal Penalties – House Will Not Authorize Impeachment Inquiry…

According to Capitol Hill members, via Politico, House Democrat leadership has taken a climate assessment of democrat House members and Speaker Pelosi announced they will not hold a House impeachment authorization vote.   As a direct and specific consequence all committee subpoenas do not carry a penalty for non-compliance.

A judicial penalty can only be created if the House votes to authorize an impeachment inquiry.  Absent a vote, the Legislative Branch has not established compulsion authority (aka judicial enforcement authority), as they attempt to work through their quasi-constitutional “impeachment inquiry” process.

Instead of subpoenas, Adam Schiff (House Permanent Select Committee on Intelligence); Chairman Elijah E. Cummings (Committee on White House Oversight; and Chairman Eliot L. Engel (House Committee on Foreign Affairs) can only send out request letters.  The compliance is discretionary based on the ideology of the recipient.

It is likely, highly likely, Nancy Pelosi does not have the votes to proceed with a full House  impeachment authorization; so Pelosi, Schiff, Engel and Cummings have to rely on the duplicity of the media to help them hide their scheme.  So far the media is complying.

Speaker Pelosi & Lawfare’s impeachment scheme can only succeed with a compliant media protecting it.  So far the media has been entirely compliant in not explaining the fraudulent basis for the construct.  If the media would ask questions the fraud would collapse.

Adam Schiff has to hide his hearings because the foundation of the impeachment fraud is to create a public impression.  There is no structural impeachment process or guideline being followed.  The committee leadership are using the closed door hearings to leak information to the media to create the needed narrative.

A legislative “letter” or demand request needs to carry judicial enforcement authority –A PENALTY– in order to be a “subpoena”.

There is no penalty that can be associated with these demands because the Legislative Branch has not established compulsion authority (aka judicial enforcement authority), as they attempt to work through their non-constitutional “impeachment inquiry” process.

It has long been well established by SCOTUS that Congress has lawful (judicial authority) subpoena powers pursuant to its implied responsibility of legislative oversight.  However, that only applies to the powers enumerated in A1§8. Neither foreign policy (Ukraine) nor impeachment have any nexus to A1§8.  The customary Legislative Branch subpoena power is limited to their legislative purpose. 

There is an elevated level of subpoena, made power possible by SCOTUS precedent, that carries inherent penalties for non-compliance, and is specifically allowed for impeachment investigations.  That level of elevated House authority requires a full House authorization vote.

In this current example the Legislative Branch is expressing their “impeachment authority” as part of the Legislative Branch purpose.  So that raises the issue of an entirely different type of subpoena:… A demand from congress that penetrates the constitutional separation of powers; and further penetrates the legal authority of Executive Branch executive privilege.

It was separately established by SCOTUS during the Nixon impeachment investigation that *IF* the full House votes to have the Judiciary Committee commence an impeachment investigation, then the Judiciary Committee has subpoena power that can overcome executive privilege claims. 

There has been NO VOTE to create that level of subpoena power.

As a consequence, the House has not created a process to penetrate the constitutionally inherent separation of powers, and/or, the legally recognized firewall known as ‘executive privilege’.   The House must vote to authorize the committee impeachment investigation, and through that process the committee gains judicial enforcement authority.  This creates the penalty for non-compliance with an impeachment subpoena.

A demand letter only becomes a “subpoena”, technically meaning: ‘a request for the production of documents with a penalty for non-compliance’, when the committee has judicial enforcement authority. That process establishes an enforcement penalty.

The current demand letters cannot carry a penalty because the demands do not contain judicial enforcement authority…. because the impeachment investigation was not authorized by the chamber.

The reason judicial enforcement authority is constitutionally required is because creating Judicial enforcement authority, creating the penalty for non-compliance, gives the Executive Branch a process to appeal any legislative demand via the Judicial Branch (federal courts).

Absent a penalty for non-compliance, which factually makes a subpoena a ‘subpoena’, the Executive Branch has no process to engage an appellate review by federal courts. This is the purposeful trick within the Pelosi/Lawfare road-map.

Pelosi and Lawfare’s plans are designed for public consumption; she/they are creating the illusion of something that doesn’t exist.  The purpose of all this fraudulent impeachment activity is to create support for an actual impeachment process.

Because the current Lawfare/Pelosi roadmap intends to work around judicial enforcement authority, the impeachment process is destined by design to end up running head-first into a constitutional problem; specifically separation of power and executive privilege. That predictable constitutional issue will end up with arguments to The Supreme Court.

THAT appears to be why Democrats and left-wing activists have been working for months to de-legitimize the Supreme Court. They always intended to run into this problem. They planned for it.

The Lawfare impeachment road-map is designed to conflict with the constitution. It is a necessary -and unavoidable- feature of their impeachment plan, not a flaw.

Speaker Nancy Pelosi and her Lawfare allies can change House rules (they did). Pelosi and Lawfare can also change House impeachment rules (they did). Pelosi/Lawfare can change committee rules (they did); and in doing so they can remove House republicans from the entire process… Which They Did.  However, what Lawfare and Pelosi cannot change is The U.S. Constitution, which they are destined to collide with.

Speaker Pelosi’s ‘Lawfare House rules‘ and/or ‘Lawfare impeachment rules‘ cannot supersede the constitutional separation of powers.

Nancy Pelosi cannot decree an “official impeachment inquiry”, and as a consequence nullify a constitutional firewall between the Legislative Branch and Executive Branch.

NO impeachment. The swing democrats know what Schiff is doing and dont want to go out on a limb for him. they have heard his bold promises and then saw what happened to cohen dean and lewindowsky. Those impeachment polls are going to collapse if hearings are held and Secuolow gets to cross examine. The Dems and Nancy know it. There cant be hearings. And the Senate uniparty is not going to let the Dem uniparty kick this over to them to handle. Nancy is going to have a vote that comes up short to end this. Or she will announce in November that it is too late to have a vote due to the election. The uniparty can never allow hearings.

      Is that true? If people honor the non-subpoena “subpoena” and come to testify before the Intel committee (that has no Impeachment jurisdiction), are they not put under oath? Aren’t they still testifying? No matter what the auspices for their appearance, if they are under oath and lie, it would seem that lying is still perjury. But who the hell knows? Understanding what is going on is difficult when it’s a phony, rule-less impeachment, I guess. Thoughts?

      Lindsey could easily be bringing folks before his committee to testify under oath in a public forum but continues to sit on his hands and Mc Connell could have ensured the Senate was in recess so PT could make recess appointments like every President before PT.

        I’m no genius and do not pretend to know how to run these entrenched hyenas out of D.C., but I like Bogey’s suggestion above about starting with Kentucky and South Carolina. On multiple occasions I have griped in these threads about “my Senate RINO” from PA: Pat Toomey. He’s not a high visibility creature, but he is treacherous to PDJT and he’s gotta go. He will be up for re-election in 2022, with two years remaining in PDJT’s 2nd term.

        Like so many people, I have known for decades that the elected pols were on the take, but I believed it was simply about lining their pockets to enjoy the good life. We have all learned that this is not the case. The slippery money is the tip of the iceberg, and there is grave danger to our Republic from the power hungry monster that has digested the souls of those we send to D.C. as “our” elected officials and career functionaries.

        The “Republican” majority in the Senate remains unmoved by our insistence that they support President Trump’s agenda. They must believe that we are bedazzled by their work on confirmation of judges, and they are hiding behind this marquee, all the while working against the POTUS, and against us, to subvert the President’s clearly expressed projects. Subvert is the operative verb, the operative mindset, and the operative determination in the United States Senate, circa 2019.

        There is not a single one of these gutless wonders – losers – betrayers – who deserves to be returned to the Senate in his or her next election. Not even one. It’s up to us to clean house.

      I would like to see one or more hosts such as Tucker or Hannity to have Volker and others who testified in the house, to be interviewed and to answer some questions in public. They could even have Jim Jordan join to also ask questions.

      I think some people who only hearing second-hand reports might be doubting, would be much more likely to be convinced by the words of Volker and others.

      While I don’t hold out much hope for uniparty republicons to do what is right, I would hope that Tucker, Hannity, and possibly others might help out.

      I also think it is time to prosecute some people under the Logan act or for foreign corruption.

  19. Maybe time to change tactics. The simple question asked by Congressman Scalise is ignored by democrats and shed by MSM as ‘partisan’.

    New tactic, we the people need to go directly to the MSM and start asking them the uncomfortable questions directly. Go to dem town halls and don’t ask the rep… turn around and ask the MSM. Flood their phones, send them letters.

    Ask them the questions they won’t ask.

    Additionally, the longer this goes on with daily news outlets, morning shows, etc incessantly using the term impeachment, without anything happening, the more the less-engaged political folks will tune it out and assume it is a sham. They had a window at the peak of the hype, and that window has closed.

    What’s more, Pelosi wouldn’t have made this ‘announcement’ if she even thought they were relatively close at getting a vote. This announcement takes all the winds out of their sails, and is in effect, a surrender.

And if you disagree with the trans-limbed you’re a whatever they wanna call you and if you fight back you’re a….a……a…..racist or something……somehow.

        My local news at 6pm had a bit about the US impeachment, I was pissed I called them and told them they were fake news. The newscaster I spoke with seemed surprised asked me why I said that? I told him if they were to report on this, explain to the people it is NOT a legal impeachment procedure etc etc I went on, he said all they do is report what they are told. At the end of our conversation, I told him they were following american talking points and FO idiots and I would change the channel when they report fake news.

    A Republic relies on a check and balance system. If Trump can reverse the welfare state, which has taught the people the ease of idleness, he will have changed the country forever. Idle people are a danger to civilization.

    The Founders of this Republic would be the first to sound an alarm of the parallels between the U.S. and Roman fall, the willingness to sell out individual freedoms and local autonomy for a mess of centralized statist and a give me all at no cost society.

    If Trump changes that mentality, he will be know as the greats President since Washington.

    So maybe the strategy is to drag this out as close to next years election as possible. But it’s almost certain that everything they are doing is somehow tested against a control group before it is done.

    I’m thinking that, beyond just the internal House DemonRAT polls, Pelousy has hired DemoncRAT’ pollsters to run continuous polls in key states to see the level of support for what the House is doing.

    At some point, her (Dem) private external polls may indicate the Dems have reached a point of diminishing return for further dragging out the impeachment scam. I’m thinking that PDJT may have some spoilers he hasn’t yet released that’ll toss a monkey wrench into the DemonRAT scam..

    I don’t see how the democrats can get out of this mess.

    – If they vote to impeach, the senate will not convict, and the evidence will be made public so that the American people know democrats were faking this whole thing.

    – If they give up and stop investigating, their base will stay home for the election, and President Trump will win in a landslide.

    – If they slow walk the “investigation” all the way up to the election in order to suppress the President’s support, Republicans will have free reign to attack their secrecy, their rules, their methods all the way up to the election. They will again lose in a landslide. Not only will they lose, they will lose their base from then on, because the true believers will hate them for not impeaching him while they had the chance, and the rest will finally see the impeachment investigation for what it was, a dirty campaign trick.

    OK, I’m confused. Today, Jim Jordon, made a distinction between last week’s impeachment interviews which were under “transcribed interview rules” and this week’s interviews which were under “subpoena deposition rules” (his words). Which means he can discuss the content of last week’s interviews but not this week’s since they are under subpoena. It sounds like Jordon believes the subpoena “letters” are legal subpoenas and therefore the testimony is secret. I have not heard anyone else bring up the difference.

      Schitt changed the hearing proceedings from “interviews” to “depositions” and trying to convince the sheep that the hearings are now like grand jury proceedings with the inherent secrecy and protections of testimony. That means Democrats can leak favorable narratives and Republicans can’t have anything to counter (like Jordan did with the Volker testimony}.

    With the election of Nancy Pelosi as Speaker (again), new rules have been adopted. Previously, one congressperson could call for a vote on the Speaker.
    Now, it takes a majority of the majority party (e.g., at least 1/4 of the House; more than half the Democrats, regardless of Republicans) to call for reconsideration of the speaker.

    In my travels I found this.. they have been trying to get rid of Pelosi since 2009

        All of what Pelosi is doing appears to be a gross abuse of her speakership power. When it was revealed that the ruling majority can change House Rules, I was shocked that our founding fathers had not established any protections from a rogue speaker. As a result American citizens are feeling very vulnerable and there appears there are no remedies except our right to bear arms which, as an old granny, is rather frightening. Surely there must be some way to stop this travesty? I am really trying not to panic.

    Seems clear to me that this s**t show is actually the DNC campaign for the 2020 elections now being run out of the House, since from what I have read their donations are down and they need to restore their coffers no matter who is revealed to be their chosen one. So the primary debates are also not primary debates.

    Thus, no vote legitimising the impeachment enquiries, because they most certainly will lose. Much more lucrative to run their campaign out of congress and get the taxpayers, all of them to fund it.

    —cites attorney/client privilege
    —omits mention of the still hidden ‘nuke’ that the House under present long established SCOTUS circumstances has no legitimate subpoena powers.

    Is a further baiting of Schiff and co into a court subpoena enforcement process they cannot in the end win.
