Why The Delay in Public Release of Key Documents?…

The possibility of U.S. Attorney John Durham exploiting/using documents declassified by his boss, AG Bill Barr, could suggest some of the material may not be made public; indeed that’s the inference from Representative John Ratcliffe three weeks ago as he outlined to Maria Bartiromo.

If accurate, it is worthwhile considering what *could be* publicly declassified by AG Barr, and yet not run afoul of any investigative value for Durham.   Example: the declassification of the Rosenstein scope memos to Robert Mueller (no longer a reason to be hidden) would not seem to materially affect the investigative intents of Durham.

So considering investigative value, what documents could be made public that would not impede Durham?

Here’s the list of material possible for declassification. This was the original list as outlined in 2018:

  • All versions of the Carter Page FISA applications (DOJ) (FBI) (ODNI).
  • All of the Bruce Ohr 302’s filled out by the FBI. (FBI) (ODNI)
  • All of Bruce Ohr’s emails (FBI) (DOJ) (CIA) (ODNI). All supportive documents and material provided by Bruce Ohr to the FBI. (FBI)
  • All relevant documents pertaining to the supportive material within the FISA application. (FBI) (DOJ-NSD ) (DoS) (CIA) (DNI) (NSA) (ODNI);
  • All intelligence documents that were presented to the Gang of Eight in 2016 that pertain to the FISA application used against U.S. person Carter Page; including all intelligence documents that may not have been presented to the FISA Court. (CIA) (FBI) (DOJ) (ODNI) (DoS) (NSA)  Presumably this would include the recently revealed State Dept Kavalac email; and the FBI transcripts from wiretaps of George Papadopoulos (also listed in Carter Page FISA). [AKA ‘Bucket Five’]
  • All unredacted text messages and email content between Lisa Page and Peter Strzok on all devices. (FBI) (DOJ) (DOJ-NSD) (ODNI)
  • The originating CIA “EC” or two-page electronic communication from former CIA Director John Brennan to FBI Director James Comey that started Operation Crossfire Hurricane in July 2016. (CIA) (FBI) (ODNI)

Additionally, since the 2018 list was developed, more information has surfaced about underlying material.  This added to the possibility of documents for declassification:

♦ President Trump can prove the July 31st, 2016, Crossfire Hurricane counterintelligence operation originated from a scheme within the intelligence apparatus by exposing the preceding CIA operation that created the originating “Electronic Communication” memo. Declassify that two-page “EC” document that Brennan gave to Comey.  [The trail is found within the Weissmann report and the use of Alexander Downer – SEE HERE]

♦ Release and declassify all of the Comey memos that document the investigative steps taken by the FBI as an outcome of the operation coordinated by CIA Director John Brennan in early 2016.  [The trail was memorialized by James Comey – SEE HERE]

♦ Reveal the November 2015 through April 2016 FISA-702 search query abuse by declassifying the April 2017 court opinion written by FISC Presiding Judge Rosemary Collyer. Show the FBI contractors behind the 85% fraudulent search queries. [Crowdstrike? Fusion-GPS? Nellie Ohr? Daniel Richman?]  This was a weaponized surveillance and domestic political spying operation. [The trail was laid down in specific detail by Judge Collyer – SEE HERE]

♦ Subpoena former DOJ-NSD (National Security Division) head John Carlin, or haul him in front of a grand jury, and get his testimony about why he hid the abuse from the FISA court in October 2016; why the DOJ-NSD rushed the Carter Page application to beat NSA Director Admiral Mike Rogers to the FISA court; and why Carlin quit immediately thereafter.

♦ Prove the Carter Page FISA application (October 2016) was fraudulent and based on deceptions to the FISA Court. Declassify the entire document, and release the transcripts of those who signed the application(s); and/or depose those who have not yet testified. The creation of the Steele Dossier was the cover-up operation. [SEE HERE]

♦ Release all of the Lisa Page and Peter Strzok text messages without redactions. Let sunlight pour in on the actual conversation(s) that were taking place when Crossfire Hurricane (July ’16) and the FISA Application (Oct ’16) were taking place.  The current redactions were made by the people who weaponized the intelligence system for political surveillance and spy operation.  This is why Page and Strzok texts are redacted!

♦ Release all of Bruce Ohr 302’s, FBI notes from interviews and debriefing sessions, and other relevant documents associated with the interviews of Bruce Ohr and his internal communications. Including exculpatory evidence that Bruce Ohr may have shared with FBI Agent Joseph Pientka. [And get a deposition from this Pientka fella] Bruce Ohr is the courier, carrying information from those outside to those on the inside.

♦ Release the August 2nd, 2017, two-page scope memo provided by DAG Rod Rosenstein to special counsel Robert Mueller to advance the fraudulent Trump investigation, and initiate the more purposeful obstruction of justice investigation. Also Release the October 20th, 2017, second scope memo recently discovered.  The Scope Memos are keys to unlocking the underlying spy/surveillance cover-up. [SEE HERE and SEE HERE]

It would appear the Rosenstein scope memos, Kavalec memo about contact with Chris Steele, original FISA application of Carter Page and transcript of Papadopoulos conversation with Halper etc, could be released without impeding a grand jury review.

The Inspector General report on FISA abuse has apparently been delayed due to the new angle of interviewing Christopher Steele.  Given the nature of this new aspect; and considering the process for a report assembly after investigation all the way to release (a minimum of a month); it is highly unlikely we will see the IG report until the end of July or August 2019… which triggers suspicions of the proverbial DC can-kicking process.

Because agencies are refusing to comply with the declassification directives of AG Barr. Question is how will Barr compel these agencies to comply? Or, on a related note, will he compel them to comply or simply shrug his shoulders. After what has happened (or more to the point what has not happened) over the past 2 and a half years, I suspect the latter is the most likely outcome. These agencies will continue to resist, and no one will push back on them.

At the end of the day, I expect no accountability for any of these criminals based on the precedent of the last several years.

I’ll add to that that most of these delays are due to the Special Counsels “ongoing investigation”. How many times did we hear that someone can not answer a question due to an ongoing investigation. The conspirators all hid behind that.

I am pretty sure that is one of the reasons a Special Counsel was created in the first place. To delay and obstruct justice as well as impacting the midterm elections by casting aspersions on President Trump. Any criminal charges would just be icing on the cake.

If they had won the Senate, this would be over. Trump would be impeached and removed from office and all investigations into the origins of the coup would immediately stop.

Well, now the investigation is over and they can not hide. It will still take some time however it cannot take so much time it will affect the 2020 elections. The indictments have to come soon even if the trials go past the 2020 election as they assuredly will. Indictments should produce whistleblowers.

Second Ex-Senate Staffer Connected to Jackson Cosko Charged in Aiding Doxxing of GOP Senators

Ex-Democrat staffer Jackson Cosko was sentenced to prison on Wednesday in what federal prosecutors say is the largest data theft in Senate history.

In October 2018, during the senate hearings for Judge Brett Kavanaugh, Capitol Police arrested 27-year-old Jackson Cosko of DC for “allegedly posting private, identifying information (doxxing) about one or more United States Senators.”

But he didn’t act alone — Cosko had an accomplice — 21-year-old Samantha Deforest Davis was charged Wednesday in federal court just hours after Jackson Cosko was set to be sentenced.

Davis and Cosko had a “close relationship” and she also borrowed money from Cosko to pay her rent, court papers say.

        A close relationship. LOL.

The crimes were committed against high ranking members of Congress eg. Mitch McConnell. It’s the other side of the coin in our two teired justice system. If you’re an elite, you won’t even be charged, much less convicted of crimes. Likewise, if you’re an elite and crimes were committed against you, the system will make sure the perpetrators are held to account. If you’re PDJT or Joe American, neither of those things will happen.

You are probably correct James. I suspect many of the documents have probably been disposed of or altered. In any event if Wray or anyone else does not produce documents that have been ordered surrendered to the AG, there is an app for that. The U.S. Marshals can serve a warrant to the people involved and compel the production of the documents.

Why that has not been done to date, we can probably figure out ourselves.

I wholeheartedly agree with this assessment. However, we were lucky to hold the Senate and therefore the failure wasn’t absolute and complete.

I am not confident in our strategy. It seemed to me that people bought the propaganda about collusion and were afraid Trump would get away with it. They wanted to elect Dems to make sure Trump and Republicans would be held accountable. The RNC did not counter that effectively. Are they doing it now? It doesn’t appear so.

While it seems like all this is unprecedented, I would argue it is not. We just have the means now to dig deeper for the truth, share info, and connect the dots. People in general, are less trusting and for good reason. The Obama administration- we clearly see much of the corruption, but I think it likely there is much more. Go back to FDR and the corruption in his years as president, the mysteries surrounding the bombing of Pearl Harbor. Handing the citizens of the US a “temporary” income tax, to which clearly the framers of the Constitution were adamantly opposed. How much long time corruption by the CIA do we know about? Look at that snake John Dean who just became part of the Dems hearings. He was the architect of Watergate and then he pled and turned everyone in! It was a planned takedown of Richard Nixon. On and on- our government has been corrupt for generations!

        Liked by 3 people

        • PBR– Regarding the CIA, here’s just a bit of information from its founder, President Harry Truman. It’s know that by the time President Truman left office, he was already lamenting that he’d created the CIA, because in that SHORT time span, Truman had pronounced it “out of control, unaccountable to any one or any agency, a Government all its own which was destroying Democracy…”

He said, “I think [creation of the CIA] was a mistake. And if I’d know what was going to happen, I never would have done it… when you can’t do any housecleaning because everything that goes on [in the CIA] is a damn secret, why, then we’re on our way to something the Founding Fathers didn’t have in mind. Secrecy and a free, democratic government don’t mix.

This was just his disgust with the CIA and the Bay of Pigs; I can’t even begin to fathom his outrage if he were alive today, to see what his odious creation had morphed into.

You ask, “How much long time corruption by the CIA do we know about?” We don’t have a clue… we don’t have any idea whatsoever what is going on over at Langley. And the CIA will do their level best to insure that it remains that way, in perpetuity.

          Burn it down.

…probably 50%..maybe more..of the people here..know the basic timing of things..the names of people involved…most of what they were doing…what I am saying is that the raw picture of when..who..how..why..ALL IS KNOWN…

..Barr..and Durham obviously know all of this..Barr has access to all docs…JUST LIKE WE KNEW HUBER WAS DOING NOTHING….DURHAM IS DOING NOTHING THAT IS NECESSARY TO HOLD ANYONE ACCOUNTABLE AT LEAST AS OF THIS MOMENT…

only 2 scenarios…1) they have people talking like Ohr…maybe Page..maybe RR…but in all honesty…all they can do is maybe fill in some details..since again..the people and actions are all well known…2) I pray I am wrong..we will get another IG report like the last one which details lots of wrongdoing..but in the end..nobody held accountable…McCabe was referred for prosecution…he is not stupid..and wouldn’t be on TV running his mouth if there was anything active against him..same for Clapper..Comey..Brennan…no way their attys would let them on TV if anything was in the process….which tells me..Barr issues a nice report about people making unwise choices against policy..but noting they will prosecute..

…one more think and I will stop..sorry..I am venting on behalf of lots of people so po’d about this…I think the only way anything significant happens is if Trump does a prime time Oval Office presser..has charts..and in 15 minutes..lays out what we already know happened..by who..for what motivation…which changes the game..takes the media off their false talking pts..puts a real stymie into the Congress investigations..and really forces Barr to do something…..thoughts??

  2. Indeed, as I review Congressman Collins’ video at the top of this piece, I am left to wonder: “why does the House Judiciary Committee(!) feel that it has no obligation, within the Legislative Branch, to investigate the ever-mounting list of things that are being quietly pursued by the Executive and Judicial Branches? All sorts of incredibly-damning things are popping out, and yet these Committees remain obsessively focused on exactly one thing: “impeaching the President.”

And so, I wonder – “why isn’t THIS ‘obstruction of justice?'” Is it actually possible – and now, I do believe that it is – that an ever-growing top level criminal conspiracy could actually protect itself by planting co-conspirators(!!) in Committee Chair positions within the US Congress?

Given that these are supposed to be “co-equal branches,” all ostensibly working for “We, the People of the United States,” why exactly is it that several key committees of the United States Congress clearly appear to be pursuing purely-political motivations that are contrary to their committees’ express charters?

“M. John, what is a Conspiracy?

“J. A Conspiracy can be described generally as a sort of partnership in crime. Legally, a Conspiracy exists when 2 or more persons join together and form an agreement to violate the law, and then act on that agreement. The crime of Conspiracy was created to address the inherent dangers posed to society when people come together and join forces to commit criminal acts. An important feature of the Conspiracy statute is that it enables the investigator to get beyond the first layer of visible members to find and prosecute the “brains” behind a criminal scheme or organization. Specific federal anti-conspiracy statutes are found throughout federal law….”

“M. What are the elements of a conspiracy?

“J. Well, there are basically *** 5 elements for the crime of Conspiracy***. Those elements are: 1. You must have 2 or more persons who 2. Intentionally 3. make an agreement 4. to violate federal law or defraud the United states, and then 5. Commit some overt act in furtherance of the agreement. Based on these elements, we know that the crime of Conspiracy is a specific- intent crime. In other words Michelle, the government must prove that these 2 or more persons intentionally entered into an agreement to commit some criminal offense. This means that in proving that there are two (2) or more person involved, undercover officers and confidential informants would not count because they would not have the requisite criminal intent. Also, the overt act done in furtherance of the agreement must occur AFTER the agreement has been reached….”

“M. What are the advantages to using the Conspiracy statute?

“J. Another advantage for law enforcement is based on the theory of ***vicarious liability. *** *** Participants in a conspiracy become criminally responsible for the reasonably foreseeable acts of any co-conspirators committed during the Conspiracy and in furtherance of the Conspiracy. In the case of Pinkerton v. United States, 328 U.S. 640 (1946)), the US Supreme Court ruled that all members of a conspiracy can be charged for crimes committed by their co- conspirators that are within the scope of the conspiracy and are a reasonably foreseeable consequences of the conspiracy.*** The benefit of this is that all reasonably foreseeable criminal acts committed by any of the co-conspirators, and reasonably related to the Conspiracy, can be introduced at trial. This is true even though those on trial may not have directly participated in the acts. In addition, statements made by co-conspirators during and in furtherance of a conspiracy are not considered to be hearsay, so can be used at trial against other members of the Conspiracy….”

Media types like Hannity ..et al.. function as pressure valves. Their constant drum beat is timed to release only enough steam to relieve the building pressure. Pressure builds up, a valve cracks open, rinse and repeat.

I have seen very few tangible signs that there will ever be justice served by AG Barr, other than a few pressure valves cracked open, like fire hydrants on a hot summer evening, or a few red herrings tossed up for public consumption, as the larger predators move to deeper waters. I wish it were different, but I think not.

The one thing that gives me hope, however, is that I don’t believe President Trump is a foolish man. Why would he expose himself AND his loved ones to the Deep State’s trillion dollar WRATH, without a fail safe plan of action? I don’t believe he would be so foolhardy.

President Trump has previously stated he feels it unwise and counterproductive to broadcast a strategic plan. He much prefers the stealth approach to blindside his enemies. I therefore trust that he will somehow deliver, but I have absolutely no idea how he plans to get there.

Perhaps that’s a good thing, because if we can’t detect the strategic moves of VSGPDJT ahead of time, then maybe the enemies of our Constitutional Republic, and the free world writ large, won’t ever know what hit them, when they are left completely and utterly destroyed.

I personally try to determine Trumps plans by watching what he DOES NOT tweet about. I feel that if he does not tweet about something that WE feel is important and not talked about, it probably means Trump is aware of it and secretly handling it in some way or timetable. So I think we just need to “Trust in Trump” until such time, if ever, that he fails to deliver what is expected, after an acceptable amount of time based on current events and future plans.

I think the white hats need to approach this thing like Al Capone or what was done to Manafort. Sick some special agents on these people and get them for easy to prove crimes like tax evasion or ‘bank fraud’ (or I don’t know – misuse of classified material).

I don’t think the white hats are going to be able to get them on spy gate. Once you have the plotters on the standard crimes, the release of the documents becomes a leverage/political tool.

LOL.

Isn’t that called Draining the Swamp? Sure looks like it to me. And this was related to the Kavanaugh Hearings!!

        • abel– Jackson Cosko wasn’t a child. He’d worked on the Hill for the past 6 years.

The suspect, Jackson A. Cosko, 27, of Washington D.C., was charged with making public restricted personal information; witness tampering; threats in interstate communications; unauthorized access of a government computer; identity theft; second-degree burglary and unlawful entry.

The judge was FURIOUS—-U.S. District Court Judge Thomas Hogan said the sentence for Cosko was needed, to send a signal that criminal harassment driven by political motives would be punished severely in an era marked by extreme political polarization.

Cosko’s wealthy parents offered to pay for his stay at a mental health facility, but prosecutors, like the judge, were intent on sending a message.

Cosko, who is currently being held in D.C. Department of Corrections’ Central Detention Facility was looking at 50 years for his crimes, but because of his first time offender status, he was sentenced to 4 years to be served in a Federal Penitentiary, not yet designated.

While Cosko wasn’t sentenced to life, it’ll be a strong message to the next Social Justice Warrior who thinks the rules don’t apply to his own sort of ‘specialness’.

  23. There are an awful lot of things that PDT “could do” – he has the absolute authority to do anything – but he also knows full well not to do them. He delegated the authority to the nation’s top law enforcement officer … authorizing the documents to be “declassified” but not(!) necessarily “to be made public.” He doesn’t intervene and he doesn’t comment.

Barr, also, knows to hold every one of his cards tightly. He doesn’t give status updates to the press. He is building cases, and the entirety of this process happens in secret. (Even in your home town, Grand Juries are secret.) The accused are not even privileged to know that a Jury has been convened to consider charges against them, unless and until a [public …] indictment is handed down.

When criminal indictments finally “drop,” the accused are going to fight back with the very best defense attorneys that money can buy, and also with the complicit assistance of the Press. It is necessary to declassify materials in order to legally present them to a Grand Jury. But if information is made available to the public in advance, this would probably destroy the cases. Technicalities would be opened and the accused would jump right through them and be gone. I think that we have to “play it Barr’s way,” frustrating though that is to all the rest of us.

Although some measure of doubt is still reasonable and even encouraged, I would point out the difference in personalities and characters of some of the people now in charge. It was only a few years ago that conservatives could only dream about someone like Donald Trump. Now he’s POTUS. Likewise AG Barr and US Attorney Durham are different from what we’re used to seeing. Was Sessions ever so bold or blunt as Barr? Does any other US Attorney have the reputation Durham has? I’ll give them the benefit of doubt until I have hard evidence to believe otherwise.
