DOJ Admits FBI Never Saw Crowdstrike Report on DNC Russian Hacking Claim…

The foundation for the Russian election interference narrative is built on the claim of Russians hacking the servers of the Democrat National Committee (DNC), and subsequently releasing damaging emails that showed the DNC worked to help Hillary Clinton and eliminate Bernie Sanders.

Despite the Russian ‘hacking’ claim the DOJ previously admitted the DNC would not let FBI investigators review the DNC server.  Instead the DNC provided the FBI with analysis of a technical review done through a cyber-security contract with Crowdstrike.

The narrative around the DNC hack claim was always sketchy; many people believe the DNC email data was downloaded onto a flash drive and leaked.  In a court filing (full pdf below) the scale of sketchy has increased exponentially.

Suspecting they could prove the Russian hacking claim was false, lawyers representing Roger Stone requested the full Crowdstrike report on the DNC hack.  When the DOJ responded to the Stone motion they made a rather significant admission.  Not only did the FBI not review the DNC server, the FBI/DOJ never even saw the Crowdstrike report.

Yes, that is correct.  The FBI and DOJ were only allowed to see a “draft” report prepared by Crowdstrike, and that report was redacted… and that redacted draft is the “last version of the report produced”; meaning, there are no unredacted & final versions.

This means the FBI and DOJ, and all of the downstream claims by the intelligence apparatus; including the December 2016 Joint Analysis Report and January 2017 Intelligence Community Assessment, all the way to the Weissmann/Mueller report and the continued claims therein; were based on the official intelligence agencies of the U.S. government and the U.S. Department of Justice taking the word of a hired contractor for the Democrat party….. despite their inability to examine the server and/or actually see an unredacted technical forensic report from the investigating contractor.

The entire apparatus of the U.S. government just took their word for it…

…and used the claim therein as an official position….

…which led to a subsequent government claim, in court, of absolute certainty that Russia hacked the DNC.

Think about that for a few minutes.

The full intelligence apparatus of the United States government is relying on a report they have never even been allowed to see or confirm; that was created by a paid contractor for a political victim that would not allow the FBI to investigate their claim.

The DNC server issue is foundation, and cornerstone, of the U.S. government’s position on “Russia hacking” and the election interference narrative; and that narrative is based on zero factual evidence to affirm the U.S. government’s position.

…”the government does not need to prove at the defendant’s trial that the Russians hacked the DNC”… (pg 3)

You couldn’t make this nonsense up if you tried…

Has Sundance ever analyzed how the DNC and Hillary Clinton stood to benefit from Crowdstrike providing them a “Russian attribution” to the alleged hack on their server?

He never touched the topic here:

Sorry if already posted, I am arguing with WordPress.
WHY would Hillary owned DNC NOT ‘Trust’ the FBI to examine the servers or do a forensic examination?

Isn’t this the SAME FBI that Hillary OWNED; Director, Deputy Director and Counter intel Director, as well as obviously whole top echelon.

The SAME FBI that buried weiner laptop, Awan/DWS laptop, and exonerated Hillary on the emails?

WHAT could possibly have been on the DNC servers that was SO BAD they couldn’t let their buds at FBI see?

Answer is NOTHING. Therefore, the excuse given for “Why Crowdstrike instead of FBI to investigate?” is a lie.

Another way to look at,it, is all I’m sayin,…..

Hillary WAS the DNC by August, 2015

Donna Brazille: “When I got back from a vacation in Martha’s Vineyard, I at last found the document that described it all: the Joint Fund-Raising Agreement between the DNC, the Hillary Victory Fund, and Hillary for America.

The agreement—signed by Amy Dacey, the former CEO of the DNC, and Robby Mook with a copy to Marc Elias—specified that in exchange for raising money and investing in the DNC, Hillary would control the party’s finances, strategy, and all the money raised. Her campaign had the right of refusal of who would be the party communications director, and it would make final decisions on all the other staff. The DNC also was required to consult with the campaign about all other staffing, budgeting, data, analytics, and mailings.

I had been wondering why it was that I couldn’t write a press release without passing it by Brooklyn. Well, here was the answer. ”

All of the evidence and information inciting the “Russia collusion investigation” constellates around Hillary Clinton. Meaning, the person ultimately responsible for “the foundation, and corner stone, of the U.S. Government’s position on “Russia hacking” and the election interference narrative” is Hillary Clinton.

        It’s treason.

“WHAT could possibly have been on the DNC servers that was SO BAD they couldn’t let their buds at FBI see?”

That is THE question, now, isn’t it?

There are several answers. One is that if the server had been examined by the FBI, a record would have been made of the information stored thereon. As we have seen with the Wiener laptop, the FBI may do a lot of things, but destroying evidence does not happen very often. As it was, the DNC was free to argue that the information held by Wikileaks was false and no one could say otherwise. Also, there was no way for the DNC to really know exactly what information Wikileaks had or what it would release. But, if there was any evidence of a crime, on the server, giving that to the FBI would run the risk of criminal prosecution.

        • Dutchman says:

Yeah, or they could get the FBI to do a lot of things, but FAKE a report saying it was a Russian hack, when it was really an ‘inside job’, and the fingering of the ‘insider’ (so he could be eliminated with extreme prejudice) was a big part of the investigation,…might be a bridge too far. Especially since such a report would be subject to FOIA.

NOT sedition, or treason, or ‘soft coup’, not without changing the law,…which requires Congress, so forget that.
SEE how tempting it is! So, got to get convictions the oldfashion way, and EARN them.
And bear in mind some of what we here on the treehouse “know”, as a result of Sundance, we KNOW, but can’t prove in a court of law, with admissable evidence.

Yes, you CAN ‘indict a ham sandwich’, but convicting it is a whole other matter.

Crowdstrike has been caught before inflating their security analysis skills and findings, leaving them open to ridicule and mockery within the IT industry. does an excellent example dissecting Crowstrike’s claims (and referencing analysis and work performed by other IT experts).
Email Dates in the Wikileaks DNC Archive; and other related posts.

Relegating Mueller’s claims for a “Russian” hacking to be based on hearsay from an unreliable witness. All investigations, arrests and prosecutions based upon that hearsay Russian hacking are now fruit from a poisoned tree.

There is a distantly related claim where an FBI employee claims he was told by OT experts that he couldn’t “copy” a cracked CD. A stunningly obtuse evasion by the FBI.

“Copy” is a common dialog program function. A function that fails if things are not perfect for it’s operation.
That does not mean a custom less fickle program is unable to retrieve information off the CD. A good IT person should be able to grab all the data items except the ones the crack(s) pass through.

Barr, Stone, Flynn and Trump need to get some genuine IT forensic experts in to help them!

Thus the Mueller Report is a Fraud and the Intel Comm Assessment of Jan 2017 is a Fraud.

Fraud – legal term meaning “use of deception for personal gain.”
The gain being destruction of the Republican US President and his administration by the Obama administration.

Read all the comments. Then went and read the Stone indictment, which has been made public. 5 perjury and one witness tampering charges. The tampering is subsidiary. The perjury charges relate to his two rounds of testimony to HPSCI concerning contact with Assange and wikileaks before and after the DNC email dump.

Unfortunately for Stone, whether Russia hacked (indictment paragraphs 1 and 2) is tangential to whether Stone lied about his Wikileaks information (sources and timing). He said under oath he had no relevant ‘documents’ when it turned out he did, and those statements and those documents are all identified in the indictment. So this post is much ado about nothing.

Mueller found no collusion. Even tho Dems won’t let go, that is the end of that. And Durham’s investigation into FISA abuse and EC predicate is not materially affected by this Crowdstrike issue.

The whole “Russian collusion” thing is built on “Russia hacked the DNC/Podesta.
They say Crossfire Hurricane was opened because Papa D had foreknowledge of the DNC hack, which on it’s face was ridiculous on several fronts, not least of which was if someone told me Russia had Hillary emails, I would take it to mean her server.

If Russia didn’t hack the DNC, just what DID they do that Team Trump could have conspired with them?

It may not help any of the defendants but it would sure help the country to know the truth

  15. Mac says:

What the federal government is saying, in this filing, is that they have NO evidence that any hacking of the DNC servers occurred or that any Russian entity was responsible for the loss of data. But, they did charge several Russian entities with crimes based upon the assumption that the DNC servers were hacked, even though they have no evidence of that or that the Russian entities were responsible. But, as Stone is not being charged with hacking the servers, the lack of evidence is irrelevant to his case. And, even if it was relevant, the DOJ does not have the evidence anyway.

What this will accomplish is to further undermine the predicate for the Crossfire Hurricane operation.

  16. anthohmy says:

This would also mean that the Obama Administration issued sanctions against the Russian government without any direct evidence. This was a National Security Investigation. Roger Stone was worthy of a SWAT team, He, Manafort, and Trump’s Personal Attorney weren’t given the option to give up or not give up his devices in a matter unrelated to National Security. The obvious answer is there was not risk from Russia at the time, just the need to create the appearance of one, a la the insurance policy.

Worthwhile in this light then to point out the Stone indictment head fake. Govt claims Stone withheld requested docs. Here is how the govt FALSELY tries to make the wiki [org 1] related Stone emails something he should have produced rather than say to HOUSE ‘he does not retain documents’
Stone Indictment page 10: (takes place after outlining email conversations that Stone had towards/about Wikileaks)
sub para a…outlines what HSPCI and SSCI were investigating.

para 19 then states how Stone leter to HSPCI is a lie to HSPCI…

Stone letter to HOUSE (even as govt submits) states that the communications sought are not in his possession “AS IS PUBLICALLY KNOWN ABOUT THE [things pertaining] to HOUSE” investigation.

sub para a…references RUSSIAN activity. It does not outline Organization 1 activity as the subject AT ALL.

YET para 19 page 10 tries to say that these emails between Podesta and source 1, 2; that ref org 1 are somehow related to sub para a…

Headfake…nothing Stone talks about is about what is alleged in para a…pertaining to Russia.

THE REASON why the DNC draft etc REALLY MATTERS is that

para a FAILS to lay guilt on Stone UNLESS there is a tie that all wiki docs ARE results of what the House is investigating in para a which is RUSSIAN hacking.

    • Daniel says:

For the love of all things clear and readable, won’t you PLEASE stop shortening “paragraph”? As I read this, I have to translate “para #” to paragraph # and “para a” to sub-paragraph a. This is a major interruption of our ability to read. If your intent is to make things harder to read, then congratulations, you just made it harder. But you also just rendered you comment to be worth less to the reader because it doesn’t flow into the brain without translation.

I get that you’re a lazy typist and that this works great in your mind as a form of shorthand. But shorthand is supposed to be for note taking and not for public consumption.

  18. JPinBalt says:

The Goverment’s response to the motion noteable never uses the identifier for “legal council” which is Perkins Coie.
“At the direction of the DNC and DCCC’s legal counsel, CrowdStrike prepared three draft reports. Copies of these reports were subsequently produced voluntarily to the government by counsel for the DNC and DCCC.”
These draft hacking reports were produced at the direction of Perkins Coie circa June 2016 for DNC, same law firm and at same time in April and Sept 2016 paid Fusion GPS on behalf or the direction of the DNC to produce the pissgate Steele dossier laundered as “legal services.”

Also note in July 2015 that Google invested $100 million in Crowdstrike, ceo Eric Schmidt wanted to be Clinton’s campaign manager before Podesta got job, but still worked closely with Clinton campaign, helping design it plus manipulating biased anti-Trump search results and news.

Like to see if Marc Elias at Perkins Coie also responsible for Crowdstrike payments for the spin doctor hacking reports. In any case, hacking reports were made at direction of, and given to the gov, by same law firm contracting the anti-Trump opposition research used both for the illegal FISA warrents and fed to press as politically motivated propaganda.

No wonder Mueller will not testify, he could be asked questions about his assertion of Russion hacking based on no evidence or hearsay say so from hired guns, less NYTs article same as “evidence.”
However, beyond the Perkins Coie/DNC/Croudstrike draft reports cited in the Stone response, seems logical there should be some grand jury testimony out there from Croudstrike in re Mueller investgation, but guess that will be sealed.

  21. Daniel says:

“Think about that for a few minutes.”

I’ve been thinking about this reality for years now. We’ve KNOWN this to be the case. We’ve known the FBI was never able to perform any examinations. If “now” is the more proper time for people to be told about this, then okay. I defer to people with strategic outlay of information.

To me, this particular bit of information has tainted every official statement made by everyone in office about the “DNC hack.” Each and every time I heard the statements ‘of fact’ that “we know the Russians did this” I immediately respond “no we don’t”…. for YEARS now.

So if finally this is the time when all of that is brought back to the public consciousness as a way of exposing the lies of Mueller’s team and more, then let’s run with it “as news.” But it’s not news. It’s somethings I’ve stewed on for years now.

And Assange … whether you like him or not. Seems its just fine to create an entire Special Commission based on nothing but a fart in the wind, basically the fruit of the poison tree, but its just NOT POSSIBLE to interview the most important FACT witness on earth in regard to this matter. Better to just lock him up and mute him, kill him slowly with chains and bindings – far too dangerous to allow his testimony, and far more preferable to bring in scum as ‘a fact witness’ like John Dean? Wake me up when they all get serious about this. Its pathetic. We here all KNEW that the FBI never got the server, it was known ages ago… I feel like I am in a nightmare loop with one awful sitcom playing over and over and no one realising its the same story.

Does anyone know if Sundance has ever written about whether there is any connection between the DCCC Debbie Wasserman Schultz & Imran Awan Dem House IT Scandal, and the DNC supposed Hack(Seth Rich, maybe)? Its always seemed plausible to me, anyway. I’ve always felt the two are definitely connected but have yet to find anyone else write about it. Or I was out that day and missed it. It would be interesting to find out.

I have not read this book because it has become so very obvious to me that things are so hopelessly corrupt that spending a lot of time to know more only serves the purpose of further confirming that and that’s a waste of time.

I won’t spend the time to read an entire book full of confirmation, I’ll just come here to spend much less time to see the latest DAILY confirmation, like the very subject of this column.

I’m even bored with Dan Bongino’s podcasts and his constant exposures of incredible corruption with no consequences. I stopped watching Fox a few months ago:

Book: Obstruction of Justice: How the Deep State Risked National Security to Protect the Democrats Hardcover – January 29, 2019

It’s like something out of a spy novel: In the heat of the 2016 election, an unvetted Pakistani national with a proclivity for blackmail gained access to the computer files of one in five Democrats in the House of Representatives. He and his family lifted data off the House network, stole the identity of an intelligence specialist, and sent congressional electronic equipment to foreign officials. And that was only the beginning.

Rather than protect national security, Congress and the Justice Department schemed to cover up a politically inconvenient hack and an underlying fraud on Capitol Hill involving dozens of Democrats’ offices. Evidence disappeared, witnesses were threatened, and the supposed watchdogs in the media turned a blind eye.

Combining tenacious investigative reporting and high-tech investigative techniques, Luke Rosiak began ferreting out the truth, and found himself face to face with the “Deep State,” observing how Nancy Pelosi’s Democrats manipulated the Department of Justice, the media, and even Republican leadership to sabotage the investigation into what Newt Gingrich calls possibly the biggest congressional scandal in history.

We may be seeing a major Left tactic in the 2020 elections taking shape” Deepfake Videos.

The prog push to ‘identify’ ‘phony’ videos posted on social media is drawing Congressional and DoD interest, DARPA’s supposed to be working on a way to detect ‘phony’ videos using defensive technology – just like the way they worked on hacking into every electronic device, including the groundbreaking work on hacking into and taking over the computer in your car.

The news tonite had a piece on Rep Schiff pushing hard for quick Congressional intervention in controlling Deepfake Videos before the 2020 election as the young voters aren’t as easily fooled by Deepfake as are older voters…see where this is going?

Look for more Congressional control over content offered in 2020 and subsequent elections, especiaslly as we ‘older voters’ (wink wink, nudge nudge) are too ****ing stupid to drink the kool aid and eat the Rat droppings.

“The government does not need to prove at the defendant’s trial that the Russians hacked the DNC”…

^This! These consistent DISTORTIONS of Due Process are BS!

And yeah, you actually do! Given it’s the entire BASIS for what your alleging against Mr. Stone! And even if it were PROVEN (unequivocally) elsewhere, Russia DUNNIT— you’d STILL need to provide ACTUAL evidence for PROOF of FACT. That should NOT include the PAID-FOR Opinion of PARTISAN Hacks.

The Prosecutorial & Investigative MISCONDUCT needs to STOP! Never seeing any CONSEQUENCES as a result– NOT a good look for those supposedly in charge.

And will Barr retract his earlier conclusions on Russia hacking?

The FBI never examined anything because it did not want to take the risk that an investigation might come to a conclusion different than the one that had already been chosen. If CrowdStrike said it was the Russians, then shut up, close the notepad, put away the pencil, that was the right answer. No point in disturbing it.

  36. jbowen82 says:

Just a note that people tend to get confused about exactly what is meant by Russian hacking. There’s no real question that Russians bought some ads on social media both before and after the election, and thre’s no real question that to this day Russians and other foreign actors get on chat forums and pretend to be Americans to try to influence public opinion and stir up trouble. However, as even Obama admitted, such efforts did not affect the outcome of the election.

I’m also willing to believe that the phishing attack that apparently got John Podesta to give up his gmail “p@ssword” was done by Russians, because of similar schemes. But to my knowledge there is zero evidence (other than CrowdStrike’s “analysis”) that the DNC emails were copied and released by the Russians.

Finally, in the biggest scandal of all, Hillary’s home server was almost certainly penetrated by multiple hostile intelligence services. Why has that escaped the public consciousness?

  37. Mark says:

I knew the entire DNC was hacked was horsesh*t when I learned the FBI never examined the server. The entire premise is fake. The DNC server was never hacked. Mueller and his entire team need to be prosecuted for fraud.

Now that the Mueller report is done can PT ask Barr that he personally wants to see the following:

    1) Confiscate, examine in detail with a detailed findings report of the DNC Server

    2) Confiscate and examine in detail with a detailed findings report of the HRC Private Server

    3) The Weiner laptop with a full detail report of ALL emails and findings on it

    4) The 47 hard drives that the NSA Whistleblower turned in to the FBI with a detailed review and report of the information contained on it.

    5) A detailed interview transcript of Jullian Assange as to his knowledge of what happened to the DNC emails and any knowledge he has of what may have happened to Seth Rich

    6) A detailed interview transcript of the NSA Whistleblower

    7) A detailed interview transcript of the U1 Whistleblower

Everyone of these items listed, the American people deserve to know the facts.

Mr. President, transparency is the only way to end this fraud and frame job. So in addition to the declassification of key documents, I ask that you included these 7 items be exposed for all Americans to see so the truth can finally come forward.

Am bleary eyed re all the comments to read on this post as well as the hour. That the FBI did not look at the DNC server, or even mention, UNTIL NOW that they NEVER EVEN READ a report from Crowdstrike on “their anal-ysis” on the hack ? Confounds every investigative cell that still resides in my being. Awesome “catch” Sundance!
After all these bitttersweet years since retiring,, I still have not read just what computers or servers were used for the UNMASKINGS of individuals (I really could have missed that). Someone enlighten me on that factoid if you can and thank you.
But can’t get the hunch out of my mind that the DNC servers were used for this purpose. After all,, if Seth Rich gave Wikileaks all of the DNC emails on a flash drive (which I believe wholeheartedly), then what other electronic trails are on the DNC servers? Why not give the computers up? Or did Crowdstrike do the dirty work of unmasking? I don’t know!
What did someone else write? ” Evidence of absence is not absence of evidence.”
As another former investigator posted earlier on this thread re being EMBARASSED about how this entire DNC server issue was handled at the FBI. I can wholeheartedly echo that sentiment.
But no matter how competent an investigator or auditor you may be, the TONE IS SET AT THE TOP. And Dom Robert Mueller has a lot of explaining to do. I’d take you to a link at Zero Hedge but I’m not wordpress savvy enough to do it..
I’m not sure who Dom Mueller’s Master is, or who or what he prays to when he goes to church (the press sure seems to like that he does so), but the sins on his soul are MIGHTY. I wonder what Jesus would say to him? Their is Some really dirty laundry he has on his soul. Only he knows the extent of his crimes, or what Master he truly serves. Have a nice day Mr. Mueller. Moron.
If I had all his crimes on my soul I would already self-flagellated myself to death. But that’s just the kind of soul I have.
Happy FATHER’S DAY to all existing and our dearly departed.

Somewhere in my comment I wanted to write Mueller’s “NO GO” decisions re allowing investigations to go forward. Tone at the top. If the BOSS says its a NO GO, all your work goes down the drain .And then you get the humiliating exercise of writing up paperwork as to why your work just “wasn’t good enough.”

Typical leftist MO. They use their comrades’ agreement as proof they’re correct.

It’s the inverse of their other MO. They claim the lack of investigation or indictment by their comrades is proof of being “scandal free.”

      What a circle jerk.
