Some recent news concerning States nullifying our out-of-control Federal government:

    https://blog.tenthamendmentcenter.com/2019/02/missouri-bills-take-on-federal-gun-control-past-present-and-future/

FTA: Introduced in the Missouri House would set the foundation create a “gun rights sanctuary state” by banning state and local enforcement of most federal gun control. Passage into law would represent a major step toward ending federal acts that infringe on the right to keep and bear arms within the state in practice and effect.

    https://blog.tenthamendmentcenter.com/2019/02/wyoming-senate-passes-bill-to-take-over-operation-of-federal-facilities-during-a-shutdown/

FTA: Introduced by Sen. Charlie Scott (R-Casper), Senate File 148 (SF148) creates a process by which the state would take over operation of federal facilities, such as national parks, “If the federal government of the United States is unable for any reason to successfully operate any national park or other federal facility located within Wyoming.”

It passed the Senate by a vote of 17-12

    https://blog.tenthamendmentcenter.com/2019/02/tennessee-legal-tender-law-would-treat-gold-and-silver-as-money-foundation-to-undermine-the-federal-reserve/

FTA: Titled the Tennessee Legal Tender Act, the legislation would make gold and silver legal tender in the state, meaning it would be recognized as a medium of exchange for the payment of debts and taxes. Practically speaking, gold and silver specie would be treated as money, putting it on par with Federal Reserve notes in Tennessee.

    https://blog.tenthamendmentcenter.com/2019/02/maryland-bill-would-end-federal-asset-forfeiture-program-in-the-state/

FTA: In 2016, Gov. Larry Hogan signed significant reforms to Maryland’s asset forfeiture process into law that also included detailed reporting requirements. But the reforms left open a loophole that created an avenue for police to bypass the more stringent state requirements.

SB764 would end the state’s participation in the “equitable sharing” program.

Some are concerned that we are still repkacing old fencing v. Making progress on new fencing. Agreed…you, me, everyone who voted for President Trump and Predient Trump ALL wish it were more, bigger, higher.

However, when we realize what fake fencing the new fencing is actually replacing maybe we can feel a little more encouraged.

This is part of the 450 miles of “fake fencing” that was authorized under fence act of 2006. It was supposed to be a dual layer fence on the border, but at the last minute, K Bailey Hutchinson (R) TX put in a rider so the next administration could pick fence type. Most of the “fake fence” that was put on the border was basically plastic that almost resembles a police tape. Andrew Wilcow talked about this in length on his radio show today.

Considering what was there before, I would almost consider this “newly” fenced as ti was easily passable prior to the new fence.

Either way, it was unsecured border before, fake fence or no fake fence. It is now much more secured.

I wish WP would hurry up and finish whatever they are doing. Kinda hard to have a conversation when you can’t post!

Here is what I think about the DHS funding deal:

1: The wall will be built regardless of whatever funds are in this bill. Trump Administration has discovered that they have already passed law on their side and they have identified $7b that can be used for the Wall. Thus, the $1.375b is a win.

2: The DEMS lost on this deal because there is now no restrictions on used of the funds other than the structure be one already in use (can you say 30ft walls?).

3: The cap on beds was halved from what the Dems demanded so now 8k less – but with a caveat that there are additional ways for DHS to fund the beds needed 😉

Lastly, I think the President can sign this bill and STILL build the Wall.

  14. More churning thoughts – Trump, stock market and Federal Reserve.
And why Trump “Cannot have his cake and eat it to.”

    1) The Fed knows that they have created massive bubbles with their zero rates free money and printing money policies. And that the stock market is STILL about 30-40% overvalued.
    2) The Fed is trying to over several years deflate this bubble without a total crash of 50%. They want a long slow mostly sideways running market to gradually deflate things.
    3) Trump hates the FED because the FED used up all the free money and easy policy on Obama.
    4) FED had been raising rates and tightening – removing money. It was going well until stocks went down 20%. But that was not the main problem. The main problem was the credit markets Seized up.. For 30-40 days no new loan issues were sold for junk or just above junk rated companies. Which is many of the companies – vast majority of small and mid cap companies are junk or near junk rated. So companies were not being able to sell debt to raise cash.

Now the pickle for FED and Trump.
    1) FED gave dovish words to calm markets saying they pause rate increases and may look at tightening schedule. And will monitor things and adjust as needed.
    2) This did calm markets and the credit markets opened up.
    3) But now things are so good again and calmer that it is likely the FED may raise rates 1-2 times this year and they were always going to continue pulling out money, they just let the markets think otherwise.

In this case Trump cannot have his cake and eat it to.
    1) The Fed only got more cautious when things got bad. Mostly in credit markets.
    2) But now that things are better, they can go ahead with raising rates and tightening later this year. Which will make things tougher for next year.
    3) The Fed was worried about the China trade issue, but if Trump keeps caving or delaying on that to boost the markets, that increases the likelihood of FED raising rates.

    Bottom line:
good markets and good economy give the Fed no excuses not to continue raising rates and tightening which Trump will not like but he is forcing them back into that mode again. Take the pain now or take the pain later? but it is coming. Most Presidents always delay the pain as long as they can and then it can bite them big time later – 2020-2021?.

Joseph “Jose” Alcoff (also known as “Chepe”) was one of three Antifa mobsters arrested and charged for allegedly committing aggravated assault and ethnic intimidation against two US Marines.

But while Democratic officials are distancing themselves from Alcoff now, until recently he was a well-connected, aspiring political player in Washington who may have even had a hand in key policy proposals.

His endorsement apparently mattered when several congressional Democrats in February 2018 issued press releases with his quote backing their bill on regulating payday lenders.

As the payday campaign manager for the liberal group Americans for Financial Reform, Alcoff participated in congressional Democratic press conferences, was a guest on a House Democratic podcast and met with senior officials at the Consumer Financial Protection Bureau from 2016 through 2018.

He was also pictured with now-House Financial Services Committee Chairwoman Maxine Waters, D-Calif., and ranking Democrat on the Senate Banking, Housing and Urban Affairs Committee Sen. Sherrod Brown of Ohio. Both committees oversee financial regulatory policies Alcoff was advocating.

Alcoff met with then CFPB Director Richard Cordray and other senior CFPB officials on April 2016, again in March 2017 and a third time in May 2017, as first reported by the Washington Free Beacon.

During this time, he reportedly was an Antifa leader in Washington.

President Trump has been the most anti-socialist/communist/Russian/Chinese leader our country (and the world) has seen since President Reagan. Or, did she smoke weed while listening to Snoop Dogg & Tupac Shakur … which means she was Still smoking weed in the early 90s as an adult, practicing law in CA, working for the gov. while it was illegal to smoke weed in that state for recreational purposes??!!

The latter, that she spoke truth but due to being a pot head got her time table mixed up and was reliving her smoking days as an adult lawyer working for the gov and breaking the law, is a MUCH bigger scoop than a Dem pandering to the African American and young voters.

I tend to the latter is true because music has a deep place in our memory so spouting what she listened to off the top of her head was probably truth as it was obviously not a carefully researched talking point.

        Lurking Lawyer here.
Saw the question and did some research. The question is ill formed.

Form I-9 is a DHS form, not an IRS form.
It is mandatory (by act of congress—IRCA 1986) for all hires after Nov 1986 for all employers, with records maintained by the employer. It theoretically establishes employer liability for undocumented employees. The catch is there is no employer liability for not checking for false documentation.

E Verify is a voluntary web based system where the employer can check the information on an I-9 against Social Security Administration (SSN) and DHS (passport, green card, H1b, or EAD (2 year work permit via form I-765). EAD eligibility is described by 8CFR274a.12, itself implementing in one place provisions of INA§207, 208, 210, and 245a (plus some more esoterica, but you get the messy drift).

Best as I can tell without a super complicated deep dive, making E Verify mandatory would require Congress to amend the 1986 IRCA . Don’t think PDJT could make it mandatory by EO. The situation is very different from congressionally passed and quite clear INA§212(f) used by PDJT EO to institute the controversial entry bans finally approved by SCOTUS—-because I-9 job applicants are by definition physically in the country already.

Thank you very much for your research and sharing your informed opinion.

E Verify is often cited as the solution to restricting/eliminating employment of illegals, especially in my state of Texas. Your assessment makes clear it is a voluntary program for use by employers, and it appears the President cannot make it mandatory via an EO.

Hence, as long as the Congress maintains its current practice of obstructing meaningful immigration reform, the President, IRS, or any government administrative entity will remain powerless to mandate enforcement of E Verify.

  29. As part of my work I have access to some interesting bank data (drawn from Federal Reserve call reports).

A couple of MAGA points from the data which totally support Kudlow and Hassert’s enthusiasm about our economy:

Total U.S. bank net loans and leases rocketed up by $210B . AND this increase eclipses any 4Q increase in the past decade. We have to go back to 3Q2007 to match this ($233B). Of this amount a large portion is loans to businesses (C+I loans) which grew $80B–actually domestic C+I loans up $86B but loans to foreign cos down $6B.–Second largest gain in U.S. history!

There are some other very interesting nuggets in the report, particularly tracking the huge decrease in Treasuries held by the Fed in the 4Q (about $53B)–as QE2 is unwound. And interestingly, almost all of these seem to have been absorbed via additions of Treasuries to several very large banks investment portfolios. Hmmm…interesting move with rates at that time projected for additional increases in 2019. Perhaps some false signals on rate trends?

More of a “build the wall topic”; I believe Soros is backing/pushing much of the open borders movement in the US and probably funding many other ugly schemes for the left. That being said; I had been wondering several months ago why all of MSM was attacking, trying to ruin Zuckerberg (Facebook) who always seemed to support lefty causes and should be “one of them”. Now I see today in an article by FOX that Facebook/Zuckerberg is and has been investigating Soros. Now it makes sense, and Soros has the MSM in his back pocket as well. Also in the article was this: “Soros is something of a bogeyman in right-wing circles due to his funding of left-wing causes both in Europe and the U.S. Hungary’s nationalist government recently passed a “Stop Soros” package to curtail his activities via his Open Society Foundations — including a measure making it illegal for non-governmental organizations (NGOs) to organize illegal immigration into the country.” Point being, most likely Soros is funding the continuous caravans to our border and at the same time probably has paid off MSM to be reporting negatively about Trump and the border wall. He is also pushing his open borders agenda in Europe and this is creating so much instability, I am afraid it is going to end in war.

Trump thanked Whitaker very clearly for his testimony. I guess Whitaker’s posture towards his Democrat questioners was a signal as to how the coup will be handled going forward. Trump has been increasingly clear in pointing out specific criticism and calling things as they are.

In a couple of days Barr may be confirmed and what will happen will play out soon. Any post-SC Trump investigations elsewhere go forward at their own risk.

Well, isn’t THIS interesting! Maybe Sundance can do a bit more in depth on this tidbit than the Daily Mail did:

    https://www.dailymail.co.uk/news/article-6695767/Lisa-Page-Quid-pro-quo-State-Dept-staff-helped-classified-Hillary-email.html

    Excerpt:

“Lisa Page fretted in the closing days of the presidential campaign about a pending Freedom of Information Act disclosure of a discussion between top State and Justice Department officials about the potential trade.

Under the arrangement, the State Department would have given the FBI more legal attachés for its overseas division in exchange for altering the basis for keeping one of the Clinton emails from the public.

At the time, the email in question was exempt from FOIA requests because it was classified – a fact that was ultimately made public. The FBI had asked the State Department to ‘change the basis of the FOIA withhold [decision] … from classified to something else.'”

Could this be the 302’s they were worrying about in their text messages?

Note from Carter L. Clews (sent 2:00 AM 2/12/19)
    Director of Communications, Judicial Watch:

“The border city of El Paso, Texas used to have extremely high rates of violent crime — one of the highest in the entire country, and considered one of our nation’s most dangerous cities. Now, immediately upon its building, with a powerful barrier in place, El Paso is one of the safest cities in our country. Simply put: Walls work, and walls save lives.”
    – President Donald Trump, State of the Union message, Feb 5, 2019

In their efforts to undermine the President, the left is spreading the myth that El Paso has never had a problem with illegal aliens and the crime they spawn.

But, as is so often the case, Judicial Watch was well ahead of the game in setting the record straight.

And this riveting video – featuring JW’s highly esteemed Director of Investigations, Chris Farrell — is a must watch for all who want to know – and spread – the truth about the illegal alien threat to America’s security:

Mick Mulvaney has said that they’ve already got more than the $5.7 billion the president asked for this time. The $1.3 billion in the offer from the Dems is obviously less than that, but the president could take it to avoid a shutdown and then declare the emergency to complete the job. One thing that is being said is that the administration is looking for the best way to do this without spending years in court battles. And, Sensenbrenner in the House and Ted Cruz in the Senate just introduced bills that would take the $14 billion they just confiscated from El Chapo and use it for the wall. Of course the Dems would not agree, but it would give Trump more power against them because then he’s got this huge sum of money coming from a Mexican bad guy and they still block it. It would set the Dems up for a huge loss in the presidential election.

Actually fixing the border problem, the court-driven loopholes spawning the Central American invasion, was never even in the cards. Trump began with a demand of $25 billion in border funding to solve a policy problem with money. Then it became $5.6 billion. In the “deal” cooked up by a congressional committee, it’s reportedly $1.375 billion, which is actually slightly less than the $1.6 billion Senate Democrats already agreed to last June! Now that we are left with enough money to build 55 miles of bollard fencing, the trade-off is not worth the money, because the cost will be borne by ICE and ultimately the American people.

Democrats were the ones who engaged in “the art of the deal” on this super-committee over border funding. Rather than discussing how to end the magnets and catch-and-release, Democrats opened a new front last week by demanding more catch-and-release through the proposal of a rigid cap on the number of beds ICE can maintain in order to detain illegal aliens, most of them dangerous criminals, through interior apprehensions. The proposal was just a trial balloon, but it allowed Democrats to then pull back from the demand, look all magnanimous and cooperative, yet still come out ahead of the game with a lower limitation on ICE detentions.

Under the committee’s proposal, Democrats and RINOs agreed to provide enough funds for ICE to house 40,520 detainees by the end of the fiscal year. Not only is that below the 52,000 request from the administration, it is a 17.4 percent cut from the current level of 49,057 detainees. The border surge is growing every day, and without any desire to get rid of the magnets and fix the court problems with asylum, unaccompanied minors, and catch-and-release, the invasion will only grow as nicer weather returns in the early spring. Trump will have fewer resources to detain illegals than under the current policy, which will induce even more catch-and release, thereby incentivizing even more illegal immigration in a perpetual death spiral for American sovereignty.

What does Trump get in return? Fifty-five miles of non-concrete fencing in the Rio Grande Valley in eastern Texas. It’s like putting a Band-aid over a gushing arterial puncture wound. I agree with Mark, this is horrible, the dems will come out as winners.

It’s a terrible deal, but he will get nothing better. The Dems are emboldened by the failure of the last shutdown, and I don’t think the President will do it again, only to eventually acquiesce once more.

The President is clearly reluctant to declare a national emergency or reprogram already appropriated funds. The Dems will force him to take Executive action to get money for wall funding, and then release a barrage of lawfare.

The President is indefatigable, and he fights on, virtually alone.

10USC284(b)(7) is very clearly stated codified law without a bunch of qualifying ifs, ands, and buts. It will give the President a ton of manpower and funds to build an effective border barrier as long as it can be tied to stopping drug infiltration along our southern border.
