Executive Branch Now Has Custody of Intel Memo For Review Prior to Release…

The media narrative engineers are busy at work attempting to cloud the constitutional framework behind the accurate, lawful, sequence of steps surrounding the Nunes House Intel Memo.  Don’t fall for the tricks.

The legislative branch has now voted in committee to declassify the House Intelligence Memo on FISA-702 abuse, and systemic fraudulent DOJ/FBI use therein.  The memo has been sent to the executive branch for review and public release approval.

The White House has five days to review. Any DOJ or FBI officials who have a position against public release are now responsible to make their case known to the Office of the President who is in charge of them, and the executive branch.

Specifically because the Chief Executive (President Trump) granted permission for FBI Director Christopher Wray to see the intelligence memo prior to the House Intel vote; Director Wray and Asst. AG Rosenstein had an obligation to debrief the executive on their findings. That’s why Wray and Rosenstein were at the West Wing yesterday.  However, the vote last evening transferred the declassification decision to the executive.

Likely the National Security Council, the Office of Legal Counsel, and all relevant Intelligence agency heads will have an opportunity to review and provide input prior to President Trump giving his final approval for declassification and making the document public.  Tweet,.. not accidental:

Following the constitutional framework, POTUS Trump now holds all the cards.

Anticipating the executive branch wanting the Tuesday and Wednesday’s media cycles to remain focused on the Presidential State of the Union address, don’t anticipate the memo release prior to late Wednesday (earliest), or, more likely, Thursday.

President Trump has keen political instincts on best timing.

With the executive holding the memo, opposing political talking-points will now shift their narrative and claim the President is undermining the DOJ and FBI with a pending release.  Opposition does not want the memo released.  It’s just pantomime politics.

The executive branch IS the DOJ and FBI; the President cannot, therefore, undermine himself.  Media opposition have worked earnestly for two years to create a false illusion of the intelligence apparatus being separate from the executive branch, they’re not. President Trump is the Chief Executive over all the agencies; just like President Obama was accountable for James Comey (FBI) and Loretta Lynch (DOJ) previously.

Then again, the prior political abuse by those agencies explains the reasoning for the media’s attempt to conflate the structure of government.  By creating a false separation they are, in essence, also protecting Obama from the discovery of any prior malfeasance within the executive branch Justice Department: James Comey, Andrew McCabe (FBI), or Loretta Lynch and Sally Yates (DOJ) et al.

Traditionally, Democrats would look to dilute any pending damage from the declassification release by leaking to the media the content therein.  However, in this example, until actually released by the executive, any leaks of content by the legislative branch are felony releases of classified intelligence.   And, remember, there’s a leak task force looking for an opportunity to cull oppositional leakers.

No doubt the corrupt officials within the FBI and DOJ, and especially those who transferred over to Robert Muellers team, have already told their media allies what to anticipate.  However, if the media release their scripts too soon those black hats are, like the legislative branch, at risk of having leaked classified intelligence.

The memo remains classified, until President Trump says it is not.  So it’s best to wait and see how President Trump, and the aligned White Hats, have decided to play this out.

Lastly, keep in mind the memo is not the valuable commodity in this move. The intelligence behind the memo is what’s important.

The more the opposition fights against the memo, the more momentum there is to declassify and release the underlying supportive documents.  Ultimately, that’s the goal. President Trump would want to draw all fire upon him and the memo bringing increased attention to it, and simultaneously providing support to release the underlying evidence.

The FBI and DOJ, or their immediate intelligence superior, DNI Dan Coats, can declassify all the underlying documents if needed; so long as they go through the appropriate channels – which means asking the Chief Executive (President Trump) for authority to do so; and going through the process of seeking input from all parties of interest including the National Security Council.   Ultimately all declassification needs executive approval.

That’s the same process of declassification previously used, and conveniently overlooked in all discussion by the media, when ODNI Dan Coats declassified the April 2017 FISA court opinion revealing the historic DOJ/FBI FISA-702 abuse reported by NSA Director Admiral Mike Rogers.

Ultimately, not only does President Trump hold authority over public release of the Intelligence Memo, President Trump also holds the declassification authority for all underlying evidence used in creating the memo.

Now you see why the Democrats were/are so apoplectic about how brilliantly Chairman Nunes gamed out the strategy.  That’s why Democrats and Media were so violently trying to besmirch Nunes personally.  He strategically outmatched them – and they were counting on using the compartmented structure of internal classified intelligence to keep the most damaging information hidden away from public view.

Where things are today appears to have been well thought out since sometime around April, May or June of 2017.

Key strategists: Dan Coats (DNI), Admiral Rogers (NSA), Chairman Nunes (House Intel), Chairman Goodlatte (House Judiciary) and Chairman Grassley (Senate Judiciary); against the complimentary timeline of Inspector General Michael Horowitz and his year-long Justice Department investigation.

None of this is random.  All of this is sequential.

    I’m a little worried that some of Trump’s advisors (McMasters, etc.) might try to get him to remove some of the more incriminating info in the memo using the excuse that its hurting our national security. Nunes and his investigators know what’s damaging to our national security so if they are ok with releasing the info in the memo, it is probably good to go.

    We need to keep pushing Trump, Congress, DOJ/OIG to appoint a second special prosecutor to fully investigate and charge the perpetrators. These traitors can not get away with what they did with just a slap on the wrist.

        When Schiff did his press conference yesterday he was ticked off because the Nunes memo was not accompanied by supporting documentation when the committee voted on it.

        In other words, when The Memo is ultimately released to we unwashed masses, he wants documents proving the claims released with it. He then went on to cry abt his little memo not being voted thru committee so it can be released, too. He didn’t mention that he would release the documents that would prove his memo to be factual.

        He wants Nunes to put up documentation to prove his memo, but Schiff doesn’t have to put up documents that would prove his??

          Schiff also did not tell anybody that the R’s did not get to read his memo before voting on it.

          Nor did he thank the R’s for doing the same thing with his memo that they did with Nunes’ memo, vote that every house member should have the right to read it.

          And follow the logic. To release the Nunes supporting documents, you have to have massive releases of FISC and other secret documents. NEVER GOING TO HAPPEN.

          Schiff is either gambling that Nunes wont try to release the source intelligence at all, or banking that if he does it will have enough redactions to allow Schiff to claim that proper context cannot be derived because of the redactions…if they are released, it must be UNREDACTED to remove this narrative that will be pounded endlessly by the MSM to discredit the memo and Nunes.
          Schiff will then claim that his memo is just as believable given the known facts if there are any redactions…and you know whos memo will be served up as gospel by the MSM.

      I used to get upset about that stuff. Now I just smile. They are helping us in so many ways. Picture commercials with them saying this nonsense in a collage with dates on them. It’s almost not fair at this point. Hopefully they continue, since it gives them even less credibility, if that’s possible.

    1. Nunes memo this week
    2. Schiff counter memo 2-3 weeks from now (March ish)
    3. Heated debate March-April.
    4. “Let’s settle this debate by releasing underlying intelligence docs” starting April
    5. Intelligence docs released May-June.
    6. Big assumption is there are items in the underlying intelligence that make Clinton campaign, Obama admin, and the Democrat party look very bad.

    That sounds like perfect timing to slow down the Democrats in the 2018 election cycle. It would be a disaster of epic proportions if the Democrats took back control of the house or senate, all their slimy tricks would be swept back under the rug. Also there are the efforts by Senator Grassley and Inspector General Horowitz happening in parallel to the Nunes “memo” effort. This is epic political drama we are witnessing, once in a lifetime stuff….

      Too slow for me. I want some cases being tried, with evidence exposed, before we get serious about the election season.

      What is most important for timing for the 2018 election season is to prevent voter fraud in all the “necessary states,” Maybe California and New York are a step too far for this year, but many other states could/should be brought into line before November. At least tax-payer funding of communist causes from the federal (and foreign) level should be excluded.

      • His speech was never going to be a big factor. The media would see to that. We will love it. Everyone else would ignore the positives and search for anything to base negatives on. The whole before and after speech narrative will be about how awful it will be/was. Now the narrative moves to the memo, with them still saying it was deceptive and awful, but everyone desperately trying to quote from it. Which means the maximum likelihood the information will get out.

        I bet Christopher Steele never wrote any memo. The only memo written was probably the one by Cody Shearer to be used as opposition research or smears against Trump for the 2016 campaign. His brother works for Mother Jones. I think they gave the research to Steele to give some weight to the “raw” intelligence to hand off to FBI. Ex spy , worked with FBI in the past, blah, blah, blah.

    I’m sure there have been meetings/discussions about a counter narrative ready to be simaltaneously released immediately after the memo itself becomes public.

    All it takes is ‘willing suspension of disbelief’ to ignore the damning facts and live in an alternative universe where Trump is always guilty of something and never vindicated

    Do not expect a consensus surrender and collective show of honesty or humility. The left is too invested in their narrative to ever step back and amend a thing.

    I think perhaps the saddest commentary on all this is that we see no outrage on the part of the left. While the GOP politicians are certainly NOT perfect….I believe in my heart that were the shoe on the other foot, they would indeed be angry with the corruption and abuse. Hope the electorate remembers this in several months when voting for the ten senate seats in states that DJT, won.

    FTA – Had Hillary Clinton polled ten points behind Donald Trump in early 2016, we’d have none of these scandals — not because those involved were moral actors (none were), but because Hillary would have been considered yesterday’s damaged goods and not worth any extra-legal exposure taken on her behalf.

    In short, such hubris was not just what Peter Strzok in August 2016 termed an “insurance policy” against an unlikely Trump victory. Instead, the Clinton and Obama officials believed that it was within the administrative state’s grasp and their perceived political interest not just to beat but to destroy and humiliate Donald Trump — and by extension all the distasteful deplorables and irredeemables he supposedly had galvanized.

      And Barack Obama? We now know that he himself used an alias to communicate at least 20 times with Hillary on her private, non-secure gmail account. But Obama lied on national TV, saying he learned of Hillary’s illegal server only when the rest of the nation did, by reading the news. Would he have dared to lie so publicly if he’d assumed that Trump’s presidency was imminent? Would he ever have allowed his subordinates to use the dossier to obtain FISA warrants and pass around and unmask the resulting surveillance transcripts if he’d seen Trump as the likely winner and a potentially angered president with powers to reinvestigate all these illegal acts?

      We sometimes forget that Barack Obama, not candidate Hillary Clinton, was president when the FBI conducted the lax investigation of the email scandal, when Loretta Lynch outsourced her prosecutorial prerogatives to James Comey, when the FBI trafficked with the Clinton-funded Fusion GPS dossier, when various DOJ and FBI lawyers requested FISA-approved surveillance largely on the basis of a fraudulent document, and when administration officials unmasked and leaked the names of American citizens.

    I wonder if the memo contains only the facts that are already known, i.e., the Memo is “just” a summary of the previously leaked/disclosed information, kind of official confirmation with footnotes, or we are going to learn something new in addition to what we already know.

    Will all our questions be answered? Probably not. Let us hope this much hyped Memo lives up to expectations and answers at least some important questions. If the communist party’s (Schiff and Co.) hysterical reaction is any indication, hopefully, schiff is about to hit the proverbial fan. Getting a bit too close for comfort to Imam Hussein? Trump called him sick and identified Hussein as the one who ordered the illegal wiretaps. He went straight to the source of corruption. He didn’t tweet “sick FBI” or “sick DoJ.”

    Can’t wait.

  36. I apologize if this seems too off topic, but I was just over at TGPundit and they were saying ‘shock poll’ (Jim over uses ‘shock’) that any type of DACA would lost Trump his base. I wrote this in reply because I think it’s over weighting a poll that is too broad and too ambiguous and too hypothetical. I think it is a bit condescending too, as if the masses can be so easily riled and driven from rational thought:

    The question becomes, do we really believe that his base is as ignorant as the left, unwilling to listen if he is able to explain,’merit based’ inclusion, documented ASSIMILATION and evident purging of criminal and cheap vote getters?

    I question any poll that asks a very broad question and doesn’t ask people whether or not they believe that Trump’s support is so ‘delicate’ that the trust that they have placed in him so far, which has continued to garner progress, cannot be continued if he is able to explain?

    People forget that he has been working on all of this immigration stuff WITH THE MILITARY and WITH LOYAL police, since long before he was elected.

    Are we so fickle as the never trumpers and the left that one very broad issue, just by being named DACA, when in fact it could be a project that looks nothing like our black/white brains had considered, is going to have us turn like a flash mob on him?

    Will it not mean, if the base turns on him, that the clear and evident present lack of anyone else, who thinks even marginally like Trump, will make us vulnerable to a crazy lunatic like Barack Obamination being nominated because we didn’t turn out to vote like a bunch of snowflake liberals?

    I don’t think that Trump would do anything without explaining in very clear terms his methodical plans. I don’t think that we would be waking up one day to his doing an Obama imperial decree that catches us by surprise.

    I don’t believe that and it disheartens me that a question that is very very hypothetical and very broad would be viewed as having so much weight.

    I think we are better than broad and obscure polls, but that is just me thinking that common sense and loyalty to someone, who clearly never had to leave the comfort and safety of his home to fight this enormous battle, is a sign of character and courage that I expect the Trump base to possess.

      I think there are a number of ways to look at this sort of poll. One is, as I’ve stated a number of times, there is no reason for those of us outside the negotiating room to pre-preemptively give away anything, especially when we are in a position of strength. In fact there are many reasons for us to go on record, as those who responded to this poll evidently did, with a very strong statement of our position.

      For one thing, if you just look back historically, every time Republicans have preemptively given away ground, they have always lost “Bigly.” But more importantly precisely when Trump is in the process of negotiating, we need to play our role, which is to stand firm and thus provide cover for our President as he negotiates.

      On the one hand, we obviously need to let Trump be Trump, but on the other hand *We* don’t need to give anything away, nor should we.

      What makes this difficult for many people is that they can’t wrap their mind around the idea that Trump is going to throw out things as negotiating positions which may or may not ever happen. But many people seem to think that if they themselves ever publicly state a position that is even a tiny bit different from what Trump has publicly thrown out on the table as a negotiating position (or ploy, or trolling his opposition) that somehow that means they are betraying Trump.


      We should stand firm with all the things that Trump campaigned on, and that he listed as non-negotiable “END” chain migration, “END” the lottery, BUILD the wall, “END” catch and release, REQUIRE E-verify, etc. etc. And at the *same* time, we must recognize that Trump is going to get the best deal he can, and there is often a lot more going on in any negotiating than appears on the surface.

      So don’t be afraid to take a firm public position that holds Trump to everything that he campaigned on. That’s not betraying Trump, that *supporting* him in his negotiating position.

    Media opposition have worked earnestly for two years to create a false illusion of the intelligence apparatus being separate from the executive branch, they’re not. President Trump is the Chief Executive over all the agencies; just like President Obama was accountable for James Comey (FBI) and Loretta Lynch (DOJ) previously.

    In my eperiences that is very telling. In that it directly connects the actions of these Exective Governmental Agencies to the Oval Office. So, if the memo is about ‘rogue’ officials politicizing their departments that one thing, but if the memo is in addition about President Obama receiving PDBs through the whole process, ie status updates, then that is something entirely else.

    That means President Obama took an active interest in the progress of the actions taken by those directly under his Administration.

    Then again, the safe bet was candidate Clinton, could not possibly loss against the reality TV star candidate, nor loss against the tweeting front runner, or then the RNC nominated candidate. Plus, if even there exist a remote possibility candidate Trump wins with his MAGA message, against the most prepared and qualified candidate in the history of the United States of America. It is never going to happen, this is politically a ‘safe bet’.

    But if it does, there is always plan B. An ‘insurance policy’ to ensnare a President Trump in a whirwind of the swamp’s making.

    How could PDJT not fail to make a move that leads to an impeachment hearing. Oh, the win-win of it all. If he loses never going to see the light of day. If he wins, Big Government will win big time in the end, we will make those deplorables regret they ever woke up and voted that day.

    That about sum it up.
