Judge Napolitano Vindicated? British Intelligence Was Used By Obama Administration to Obtain FISA Warrants On Trump Team…

On March 14th Judge Andrew Napolitano said:

“Three intelligence sources have informed Fox News that President Obama went outside the chain of command. He didn’t use the NSA. He didn’t use the CIA. He didn’t use the FBI, and he didn’t use Department of Justice. He used GCHQ. What the heck is GCHQ? That’s the initials for the British spying agency. They have 24/7 access to the NSA database. So by simply having two people go to them saying, ‘President Obama needs transcripts of conversations involving candidate Trump, conversations involving president-elect Trump,’ he’s able to get it, and there’s no American fingerprints on this.”

On March 20th Fox News suspended Napolitano for making those remarks.  The British government and British intelligence community was furious at Napolitano and Fox News.  At the time Rupert Murdoch was attempting to purchase SkyNews, which might have aided in the severity of his response to Napolitano.

However, today CNN is confirming much of the construct for what Napolitano was previously saying: 

CNN – British and other European intelligence agencies intercepted communications between associates of Donald Trump and Russian officials and other Russian individuals during the campaign and passed on those communications to their US counterparts, US congressional and law enforcement and US and European intelligence sources tell CNN.

The communications were captured during routine surveillance of Russian officials and other Russians known to western intelligence. British and European intelligence agencies, including GCHQ, the British intelligence agency responsible for communications surveillance, were not proactively targeting members of the Trump team but rather picked up these communications during what’s known as “incidental collection,” these sources tell CNN.

The European intelligence agencies detected multiple communications over several months between the Trump associates and Russian individuals — and passed on that intelligence to the US. The US and Britain are part of the so-called “Five Eyes” agreement (along with Canada, Australia and New Zealand), which calls for open sharing among member nations of a broad range of intelligence. Against the backdrop of President Obama’s National Security Advisor Susan Rice finally admitting she was the White House entity who unmasked the names of U.S. people contained within U.S. intelligence reports, the prior substantive concerns of Judge Andrew Napolitano appear confirmed.

It would appear the justification for the early 2016 President Obama surveillance program was, in part, constructed by utilizing information from British intelligence sources.

Earlier we considered that NSA Director Mike Rogers didn’t want to participate in, or give aid in relationship to, the surveillance scheme.  Consequently, the Obama White House worked around Rogers with another source, British Government Communications Head Quarters (GCHQ), for the same information.

In 2013 Edward Snowden released information the UK GCHQ was being party funded by the U.S. NSA to the tune of over £100 million:

[…]  The funding underlines the closeness of the relationship between GCHQ and its US equivalent, the National Security Agency. But it will raise fears about the hold Washington has over the UK’s biggest and most important intelligence agency, and whether Britain’s dependency on the NSA has become too great. (link)

January 23rd, 2017, three days after President Trump’s inauguration, the head of the U.K. General Communications Head Quarters (GCHQ) unexpectedly resigns:

Robert Hannigan, the director of GCHQ, has resigned from his job as head of one of the three Government intelligence agencies after just two years.

GCHQ would only say that Mr Hannigan had left his post for “personal reasons” and that he was not sacked or subject to disciplinary proceedings.  (link)

[Previously] In hindsight, NSA Director Admiral Mike Rogers may have notified Team Trump of Obama’s Intelligence Community (James Clapper and John Brennan) involvement or engagement in surveillance activity.

As you look at the dates below, it’s important to note that NSA Director Admiral Mike Rogers would be keenly aware of both the June FISA request – Denied, and the October request – Granted.  Pay specific attention to the October request. “October”!.

June 2016: FISA request. The Obama administration files a request with the Foreign Intelligence Surveillance Court (FISA) to monitor communications involving Donald Trump and several advisers. The request, uncharacteristically, is denied.

October 2016: FISA request. The Obama administration submits a new, narrow request to the FISA court, now focused on a computer server in Trump Tower suspected of links to Russian banks. No evidence is found — but the wiretaps continue, ostensibly for national security reasons.

Andrew McCarthy at National Review later notes. The Obama administration is now monitoring an opposing presidential campaign using the high-tech surveillance powers of the federal intelligence services.

♦ On Tuesday November 8th, 2016 the election was held.  Results announced Wednesday November 9th, 2016.

NSA Director Rogers participates in session at Intelligence and National Security Summit in Washington♦ On Thursday November 17th, 2016, NSA Director Mike Rogers traveled to New York and met with President-Elect Donald Trump.

♦ On Friday November 18th The Washington Post reported on a recommendation in “October” that Mike Rogers be removed from his NSA position:

The heads of the Pentagon and the nation’s intelligence community have recommended to President Obama that the director of the National Security Agency, Adm. Michael S. Rogers, be removed.

The recommendation, delivered to the White House last month, was made by Defense Secretary Ashton B. Carter and Director of National Intelligence James R. Clapper Jr., according to several U.S. officials familiar with the matter.

[…]  In a move apparently unprecedented for a military officer, Rogers, without notifying superiors, traveled to New York to meet with Trump on Thursday at Trump Tower. That caused consternation at senior levels of the administration, according to the officials, who spoke on the condition of anonymity to discuss internal personnel matters. (link)

Remember, historically The Washington Post is the preferred outlet for the CIA and Intelligence Community within Deep State to dump their “leaks” and stories.  [The State Department “leaks” to CNN for the same purposes.]

♦ On Saturday November 19th Reuters reported on the WaPo Story and additional pressure by Defense Secretary Ash Carter and DNI James Clapper to fire Mike Rogers.

[…]  The Washington Post reported that a decision by Rogers to travel to New York to meet with Trump on Thursday without notifying superiors caused consternation at senior levels of the administration, but the recommendation to remove him predated his visit.  (link)

If you just look at the timeline of activity a picture emerges:

  1. The Intelligence Community -at the direction of President Obama- made a request to a FISA court for the NSA to spy on Donald Trump in June 2016.  It was denied.
  2. In October the Intelligence Community (NSA) -at the direction of President Obama- made a second request to the FISA court for the NSA to spy on activity around Donald Trump.  It was approved.
  3. At around the same time (October), as the second request, (Def Sec) Ash Carter and (DNI) James Clapper tell President Obama to dump NSA Director Mike Rogers.
  4. A week after the election, Director Mike Rogers makes a trip to Trump Tower without telling his superior, James Clapper….
  5. …Which immediately brings about new calls (November media leaks to WaPo) for President Obama to dump Admiral Mike Rogers.

    Muh Russia “investigation” will never stop until Comey is fired and a few Obama henchmen indicted.

    The deep state will keep the President under a “FBI criminal investigation” until 2020 so the challenger can smear him as a Russian spy or something. If GOP manages to lose the Senate majority in 2018, there will be five grand juries and a grand inquisition on top of that. We all know that the R wing of the Uniparty will be happy to cooperate in a bipartisan way. It must never happen.

    All these articles that keep popping up in the fake news serve the purpose of keeping the story alive at all cost, and maintain the optics of a vast Trump-Russia conspiracy which was “independently” investigated by various Intelligence Agencies. You will always find mentions of “multiple contacts between Trump staffers and the Russians,” and the “close ties between this or that individual to the Russian banks” which implies money transfers.These articles are not about uncovering “truth” and have nothing to do with real investigative journalism.

    DoJ should finally get involved.
    The demonrats delayed the confirmation of Rod Rosenstein because only he can go after Rice and company. We can only hope he will.

    GCHQ and America’s Secret Services have been hand in glove for DECADES. At the end of WW2 an agreement was made between GCHQ and the American, Canadian, Australian and New Zealand Secret services to SHARE all the intelligence that was gathered from the Trans Atlantic telephone cables which TERMINATED in the UK before onward distribution across Europe. ALL calls were monitored for KEY words and phrases and recorders switched on if they were heard . In return for SHARING all this INTELLIGENCE DATA with the USA the USA agreed to share ATOMIC WEAPON secrets with the UK.

    All this starts out with the Five Eyes.

    The “Five Eyes” (FVEY) refer to an alliance comprising Australia, Canada, New Zealand, the United Kingdom and the United States. These countries are bound by the multilateral UK USA Agreement for joint cooperation in signals intelligence, military intelligence, and human intelligence.

    They collect ALL data 24 / 7.

    In the USA, a FISA warrant is required to access the data. Not so in the other countries if they want to access data pertaining to the US. (read above again)

    So, Obama gets GCHQ in the UK to access Trump data and then ship it to him.

    Trump gets elected, no more cover for Obama, Trump now President , has access to everything, Robert Hannigan (GCHQ) resigns, (knowing it will all come out).

    This whole mess is about to blow right up in Obama’s face.

        This is what Snowden exposed in 2013. Google/Yahoo front end server metedata was being mined “overseas” by GCHQ and our own NSA, to circumvent FISA warrant requirements. “Wow” is chillingly understated…

      Exactly…Snowden was a precursor to so many things that Wikileaks and others are now releasing and the American people are now finding out how long our gov’t has been surveilling us and told us we had 4th, 5th, and almost every other of the Bill of Rights to protect US, we the people.

      What is sad as a member of the IC is that you discover how many laws/rules are actually broken by said gov’t…all under the auspices of “keeping us safe…” Ben Franklin quote comes to my mind: “Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.”

      I wonder who on the Select House Committee on Intelligence will ask FBI Director Comey why the DNC refused to let the agency examine it’s computers. Why did the DNC choose
      CrowdStrike to examine it’s allegedly hacked computers? Let us see the connections between CrowdStrike and the DNC please. We need to see proof that “the Russians” hacked the DNC or did Seth Rich or another person who worked for the DNC leak the Info. Do any of these people testifying know who ordered the hit on Seth Rich? Who murdered this young man? Somebody knows, the murder was not a random kill.

          There may be some truth to the matter that Julian Assange or Snowden are Russian agents. They are at least used by them. I think he made that statement while in Russia because to not make that statement would have been a great miscalculation. It would be all we heard in the press. Tillerson is a very very smart problem solver. First law of problem solving, identify the problem, and second law address it.
          Surely Russia did something, even if they didn’t actually hack into the DNC. I think they really thought it was a done deal that Clinton would win and just may have tried feebly to get a bargainin chip on her, tarnish her. I don’t think they tried to help Trump win.
          So Tillerson is using the tools he got, even if their from the other guys tackle box.
          He’s good. He’s from Texas. I think its true is mom is Bobby Sue and his dad is Billy Bob.
          This was the second best pick on the Cabinet.

    Largely un-noticed in the sensational events, our NSA may have saved Prime Minister Theresa May’s life during the recent Westminster attack by Islamist terrorist Khalid Masood.

    Just as GCHQ has operatives working alongside our NSA at Fort Meade, NSA has operatives at Menwith Hill, Britain. This arrangement has permitted the NSA to develop close working relationships with Britain’s SAS, their version of our Secret Service, from whom they may have learned about Masood.

    Masood was a very bad character whose knifing propensities seemed to be protected by unknown elements operating in London. Minutes before Masood started his parked van, he received a message that London’s Metropolitan Police were opening the gates to Westminster Palace (for the arrival of London Police Commissioner Craig Mackey). Masood charged across Westminster Bridge, as best he might given his condition, gained access to the parking court, through the opened gates and proceeded to stab PC Keith Palmer, an un-armed London Bobby.

    Before Masood could be guided through the Palace of Westminster to Theresa May’s office (possibly by one or more dodgy Metropolitan policemen on duty), he was shot by Britain’s SAS, who coincidently happened to arrive in the parking court just before, inexplicably armed with riffles.

    Saving Prime Minister May’s life was wonderful. However not knowing who was to guide Masood through the Houses of Parliament to her office, must be disconcerting to Mrs. May.

      As glad as I am that some lives have been saved, it is wrong to use these to justify unconstitutional spying by the US and UK. This story can’t and won’t present all the negatives that have come out of freely disregarding the right to privacy. I have to consider that some element of the intelligence mafia or community was directing this attack, while being also praised for stopping it.
      This story won’t touch on the fact that many intelligence agencies are funded in part by engaging in black market activities and that they don’t seem to be strictly in the control of any government. Let us not justify evil because one evil happens to thwart another evil. (Al Qaeda fighting Russia, Gladio guerillas bombing citizens to fight European socialist movements, ISIS is fighting Assad, this theme is repeated ad nauseum, “support evil, for good!”) We need to reject helping Satan in the name of God.

    It’s yet another trade agreement which needs to end. Foreign/globalist actors do not need to infiltrate the US — just one of the other “eyes.” When you lose control over the intelligence, you can pretty much assume it’s going to be seen by the wrong people. It’s just the dumbest thing ever unless you’re a globalist trying to take down the nation which poses the strongest resistance to globalism.

    Think about what it means for a purported (VERY purported) news outlet actually SUSPENDING an employee for saying something that the management didn’t for.

    And in this case, the employee is NOT EVEN a “news” reporter – he’s one who’s paid to provide opinion.

    If FNC needed to have a “reaction”, it could have been “We do not agree or approve of everything said on our news channel. Our commentators are free to comment as they see fit, within the bounds of decency and sanity.”

    There are still too many people who think Fox is the “good” news channel.

      I agree, the October FISA…doesn’t fit the time line…they knew by October that Hillary was not a shoe in, and they got scared that Trump really had a chance, so the October FISA was a CYA move, to if needed explain that incidental info was shared widely and “so sorry” it was leaked.

      The Obama administration used a loop hole to obtain intelligence to be used politically against their “opponentS”

    Here’s my theory based on the puzzle pieces in view. It is simpler that Napolitano’s concept, which requires messy communications and international collusion:
    1) As a matter of routine, allied surveillance operations such as GCHQ send data to US intel agencies, on basically everything they pick up involving contacts of US persons with foreign intelligence operations, government officials, big time criminals, and other individuals under specific investigation.
    2) US Intel Community screens that data for anyone and anything of interest to them, and theoretically routes it for appropriate analysis and use. Brennan and/or Clapper cause the data to be filtered for hits on anyone they can connect to Trump or his campaign.
    3) They then forward that data to National Security Advisor Susan Rice, who unmasks anyone she thinks might be politically embarrassing to Trump, and distributes it for others to leak to the media, and put it in the hands of the Hillary campaign.

    No need for communications to GCHQ, et al., to order up surveillance on any individuals. Allied surveillance operations do not have to be “in on” a conspiracy, or even know what the US does with the information, and thus have complete deniability. News reports, based on leaks, might claim that GCHQ started sending reports about X in summer 2015; but in actuality that is when the CIA and White House started mining the normal data for Trump-related hits.

      Undoubtedly much of CGHQ’s surveillance of Americans is transmitted to the NSA as a function of established protocols.

      However, the 6-hour time difference alone may justify the presence of British operatives at Fort Meade, Maryland and our operatives at Menwith Hill, Britain. (it is awkward to develop a working partnership if your counterpart in Britain leaves leaves at 11:00 AM Fort Meade time.)

      Per my earlier post above, our NSA officers in Britain may have bypassed customary London police channels and communicated directly with Britain’s SAS, who promptly neutralized Khalid Masood. Is is significant that London Police Commissioner Craig Mackey, who witnessed Masood’s stabbing rampage and the SAS shoot-out, took no action to recognize / reward PC Keith Palmer who gave his life blocking Masood?

    A couple of the things that rankle me (among many): the nitpick about his choice of the wording “wiretapped”. That’s why he put it in quotes, is it not? I think it is the EM’s pretense that they don’t understand communication in the English language that get to me there.
    The other thing is their talking point that he claimed it “without proof”. As if we didn’t see (expletive deleted) Scott Pelley do a whole Russian connections hit piece during the coverage of the Trump inauguration. No proof required that day.

    I vividly recall way back when Bush 2 was in Office, Judge Napolotano argued against the Patriot Act by asking if people would feel safe if Hillary was in office rather than W. The question is no longer rhetorical. We need to dismember our internal security agencies. They have become a greater threat to our safety and freedom that the Islamic terrorists.

    We are gong to learn soon that Susan Rice and Obama had been going to the British to get illegal intelligence to use as political ammunition, for years…and when they realized in October that Hillary was not going to win, they had to scramble and get what would appear to be “legal FISA order”, to “use” (red herring) to cover up the fact that they had been obtaining and using illegally obtained intelligence all along. They will pretend that they were “covered” with a “legal FISA”.

    None of this would have come to light had Hillary won, but their gamble and or luck was running out and they knew they had to cover their tracks, hence the “late in the game” FISA in October.

    The FISA request are well after the fact, they had all the Trump surveillance way way before October.

    The October FISA, was done so they can pretend that they had been doing all this legally, and that she unmasked info from a legal FISA…all for show. A dog and pony show meant to distract us from their illegal activities.

    The October FISA is a fake bouncing ball, they want us to follow….it’s fake…follow judge Napolitano he knows that the Obama administration was doing all the spying illegally, leaking illegally and now is trying to cover it up with the way after the fact October FISA order.

    Apparently, the symbols for ‘more than’ and ‘less than’ are not allowed
    under any circumstances (I had included them above after the word “symbols”).
    Curious.

    Point is, that in any given article on this site, there are glaring mistakes.
    Not so much errors of grammar or spelling, but simple typos, and duplications.
    Just having one person who has not written or typed the article read through it
    once, even quickly, will easily remove most or all of these errors.
