While there is much pontification and opinion about a judicial ruling by New York Judge Ann Donnelly, the decision is actually quite narrow. The judge’s involvement is specifically and narrowly only targeted to current permitted visa holders who were in the limbo zone between travel (during XO) and the denial of entry upon landing.
Despite the insufferable airport protests being promoted on U.S. MSM, there are less than 200 people nationwide who were in the limbo zone. The ruling stops DHS from forcibly turning around a group of currently valid visa holders arriving from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Nothing more.
NEW YORK […] U.S. District Judge Ann M. Donnelly ordered a halt to any removal of refugees or others who hold valid visas to enter the United States—meaning those who have arrived at U.S. airports from the seven predominantly Muslim countries named under the President’s executive order can remain, for now.
The judge did not rule on the legality of the executive order, nor did she say that others who have not yet arrived in the U.S. can be allowed to proceed. [She’s simply clearing the airports.]
The ruling came in response to a petition filed by the American Civil Liberties Union on behalf of two Iraqis detained at John F. Kennedy International Airport: Hameed Khalid Darweesh, who was a translator for the U.S. military, and Haider Alshawi, who was on his way to join his wife, who had worked for a U.S. contractor in Iraq. Yes, a Fed Judge can ‘override’ an Exec. Order/Action. But only temporarily. It’ll go to the Supremes next (they can expedite it if they want to, because it’s a National Security order).
However: ‘The 2 Iraqi men’ here are NOT ‘good muslims’. Or they wouldn’t have planned this WITH: lowlife Nadler and the ACLU, both of whom were on hand for the presser.
The ACLU has launched this as a ‘test case’, and it took some preparing. Bad idea ACLU. Really, really bad idea.

And yes, the vast majority of ACLU law-yuhs are self-hating Jew haters.
The second one loved it. Of course: he WAS a totally obnoxious individual who got his kicks trying to bully anyone he could (very few) all throughout Law School.
Last I heard he was still there, obnoxious as ever. The perfect ACLU hire!

The stay granted by the judge only pertains to those who were already physically present in the United States, or in transit to the United States at the time the Executive Order was signed. Utter B.S. The House of Saud and the sitting prince’s authority is extremely tenuous. Rule & control over Saudi Arabia and Islam’s holy places by the House of Saud was secured in 1979 during the Siege of Mecca with the understanding that the House of Saud holds sway ONLY so long as they maintain their agreement with Islamic hardliners to use their newly acquired oil wealth to spread Islam globally by ANY and ALL means as dictated by Islamic doctrine and interpreted by Islamic scholars and hardliners – just as the Islamic ringleader Juhayman took seige of one of the holiest places in all of Islam, Mecca. Muslims are the biggest victims of Islam throughout history. They willingly sacrifice their own to achieve doctrinal ends. For Rudy to suggest that Saudi Arabia is very different simply because their mortal enemy, Shia Iran was gaining strength during and with the aid of the Obama administration – is very short sighted if not utterly blind to this enemy and this enemy’s purpose. The ‘gates of ijtihad’ are closed for over a thousand years. Islam will never moderate, no matter what fairy tales our politicians prefer to take to bed.

So they are trying to beat us and the POTUS with the only branch still in their pockets, and get the media pile on, in a desperate attempt to retain some credibility.
And they wouldn’t really have that if Judge Scalia had not “died under suspiciouscircumstances.” (murdered, IMO)

There is a provision in the EO that would allow for visas to be issued to people on a case by case basis.
Couldn’t this provision be used to allow the travelers in if they have documents ? In other words, once they landed they will be reviewed individually or case by case
basis.
(g) Notwithstanding a suspension pursuant to subsection (c) of this section or pursuant to a Presidential proclamation described in subsection (e) of this section, the Secretaries of State and Homeland Security may, on a case-by-case basis, and when in the national interest, issue visas or other immigration benefits to nationals of countries for which visas and benefits are otherwise blocked.

Hopefully soon. The activist liberal judge’s stay is baseless. Title 8 chapter 12 USC 1182 is quite clear😎

This Birdbrained Judge may be in hot water. What did she stay? Nothing at all. Her order caused chaos and mayhem nationwide. Did she apply any law to any fact? What was the issue? The case was without any merit at all other that to cause trouble. That is not her job description.

The judge is definitely ‘bird-brained’ but she has to respond to all Motions before her Court.
The ACLU knows who to ‘shop’ their motions to. Connelly’s #1 on their list of ‘friendly judges’.Of course she’s a fool and a clown. She’s an Obama appointee, a recent one.
Not to worry. Pres. Trump’s naming his Supremes pick this week. He/she will be confirmed within a month, and sitting ON the Court. Where all roads-including this short-cut by Donnelly-inevitably lead.
Our President doesn’t like it when his orders aren’t enforced. And unlike Obama; Pres.Trump WANTS to go to court. Where he-we-will win.

It seems to me that those who had already arrived were being vetted and released. Three were allowed entry before thiss Judges order.
Fascinating to see the complete and total meltdown of the left this week, they have a protest ready for everything! They must be getting tired by now … poor snowflakes.

I have one fb friend who is in absolute melt down & I’m sitting over here nice & calm but I’m beginning to feel tired for her. lol.
The funny thing is that she is an attorney & ready to run to airport but doesn’t know immigration law.

I wonder how many attorneys went to the airports today ?
Kind of reminds me of when attorneys swamped the border to help Obama’s children get in back in 2014. I remember pics of cars with phone numbers & ads on them.

Shall we refer to them as “H-visa chasers”? 😀

I guess since the MSM has nothing else better to do – they need to fabricate a crisis so they can report on it.
It will certainly be interesting to see how long the airports will tolerate this nonsense, especially if a prolonged incident disrupts airport security and service.

Alas! The marvelous NYPD is still under Red Bill, who’ll do everything he can to keep NY’s finest from arresting ANYBODY (as of this writing there have been lots of ‘detentions’ of rioters, but no arrests.
That’s OK. Trump’s in the WH. If necessary, he’ll send in the Feds. And I mean he WILL send in the Feds. Black eye for Red Bill and his lesbo commie BLM wifey!

This is also a reminder to us and President Trump that we want good, Constitution-minded judges on all the federal courts, not just SCOTUS.

It seems reasonable to me to allow those passengers travelling with valid visa’s and who were in the air when the EO was signed to be allowed entry into the U.S. – to deny entry seems unfair and counterproductive – imagine obtaining a valid visa for travel to the U.S. only to be turned backed on arrival after paying for an expensive ticket.
It is unfortunate that this situation arose in the first place because it could have been avoided and I don’t think it helps President Trump that major protests broke out at major airports. All this does is make President Trump look like a bully while engendering sympathy for Muslims.

I doubt it was President Trump’s intention when he signed the EO that passengers already in the air and headed to the U.S. with VALID visa’s would be denied entry to the U.S. upon arrival. It goes against basic fairness. I can’t imagine he is happy with how this turned out.

I think it had to be this way in order to not give the bad guys a heads up to hurry up and get into our country before the ban. But they should have let those with valid Visas in.

I bet they planned on letting them in but the left had to start their circus act before there was time to check their documents.

Yes, the administration did not want to give heads up. That would have allowed anyone with bad intentions to arrive prior to EO.

Agree that this is a nothing burger, but looking past 120 days something needs to be done, an idea.
All visas issued have a expiry date iirc.
I read somewhere that 40% of illegals in the U.S. were here on visas and did not leave.
Some countries I traveled fined you for every day overstayed. No money, then jail then deported.
I think all people coming in on visas should be photographed, fingerprinted, and put in a national database. If caught overstating, fined, and deported.
No EO needed just state department visa rules added. Vetting if needed.

Cites equal protection in the ruling, but the Constitution does not apply to non-citizens. It won’t hold.

As Sundance pointed out, the judge did not rule on the legality of the executive order, it is perfectly legal. The press is gleefully hyperventilating over the “defeat of that bigot” Trump, such is their hatred.
8 USC § 1182(f) Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.

Folks, Breitbart is reporting that terror group CAIR is the organizer of the protests nationwide.
I wondered who got them up an at ’em so fast. Obviously coordinated centrally somewhere.
