New York Federal Judge Intercedes To Clear Airports of Current Limbo Visa Holders…

While there is much pontification and opinion about a judicial ruling by New York Judge Ann Donnelly, the decision is actually quite narrow.  The judge’s involvement is specifically and narrowly only targeted to current permitted visa holders who were in the limbo zone between travel (during XO) and the denial of entry upon landing.

Despite the insufferable airport protests being promoted on U.S. MSM, there are less than 200 people nationwide who were in the limbo zone.  The ruling stops DHS from forcibly turning around a group of currently valid visa holders arriving from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen.  Nothing more.

Donnelly ordered a halt to any removal of refugees or others who hold valid visas to enter the United States—meaning those who have arrived at U.S. airports from the seven predominantly Muslim countries named under the President’s executive order can remain, for now.

The judge did not rule on the legality of the executive order, nor did she say that others who have not yet arrived in the U.S. can be allowed to proceed.  [She’s simply clearing the airports.]

The ruling came in response to a petition filed by the American Civil Liberties Union on behalf of two Iraqis detained at John F. Kennedy International Airport: Hameed Khalid Darweesh, who was a translator for the U.S. military, and Haider Alshawi, who was on his way to join his wife, who had worked for a U.S. contractor in Iraq.  (read more)

    The Constitution is quite clear on the President’s power to enforce the law especially in relation to immigration as the treasonous actions of former President Obama made quite clear.       The lunatics at the ACLU fell for this hook, line and sinker. By filing their Motion to stop this, they’ve tee’ed up the Administration’s IMMEDIATE appeal of this stupid judge’s order, which is going straight to the Supremes.

      Oh-but not until Pres. Trump has placed his first new Constitution-loving-Roe-hating-religious-test-allowing-in-immigration-cases Supreme Court Justice, ON THE COURT.

      One thing the left has yet to learn about Pres.Trump: He’s the deal-maker of the universe because he’s light-years ahead of the competition in his chess moves.

          Rest assured that our beloved President vets every single Exec. Order/Action before it sees the light of day. Pres.Trump only pretends to be ‘impulsive” and he never is where it really matters. I’m a transplanted New Yorker who grew up watching The Donald. He didn’t win every single transaction in which he ever engaged by going off half-cocked.

      Yes, a Fed Judge can ‘override’ an Exec. Order/Action. But only temporarily. It’ll go to the Supremes next (they can expedite it if they want to, because it’s a National Security order).

      However: ‘The 2 Iraqi men’ here are NOT ‘good muslims’. Or they wouldn’t have planned this WITH: lowlife Nadler and the ACLU, both of whom were on hand for the presser.

      The ACLU has launched this as a ‘test case’, and it took some preparing. Bad idea ACLU. Really, really bad idea.

          When I was first out of Law School I knew two fellow grads who went to work for them. The first one left after 5 months because he couldn’t stomach the hatred for the USA, Western Civilization in general, Christianity, and esp. Judaism (my friend is a Conservative religious Jew). And yes, the vast majority of ACLU law-yuhs are self-hating Jew haters.

          The second one loved it. Of course: he WAS a totally obnoxious individual who got his kicks trying to bully anyone he could (very few) all throughout Law School.

          Last I heard he was still there, obnoxious as ever. The perfect ACLU hire!

    The stay granted by the judge only pertains to those who were already physically present in the United States, or in transit to the United States at the time the Executive Order was signed. It likewise only pertains to those with valid, legal visas. The Executive Order remains in force with respect to all would-be travelers and refugees from the seven program countries referenced in the Executive Order.

          I think Trump hasn’t shown all his cards on this, not by a long shot. Saudi and Pakistan have many problems, and toppling either of those two right not could just make a bad situation worse (cf Libya, Iraq). Take out the small ones before going toe-on-toe with the big ones. And, get everyone confirmed, and judgeships filled.

          The swamp, thanks to the likes of ACLU, SPLC, CAIR, and a host of ne’er-do-wells, in addition to the remnants of Øbozo, the Clintoons, and the Paedostas and their ill-begotten ilk are going to be fighting the Trump administration tooth and claw.     You have to read the stay order. It only restrains the government from removing affected persons from the US, until a hearing can be held. It does not authorize their release into the country. So, they can be held in detention, until a judge rules otjerwise.

    Thanks to Sundance for clarification… my 17 year old who has been raised right( big time Trump supporter) yells out “Mom a judge just overturned his executive order on immigration it’s all over Twitter… all the libs are having a field day, celebrating a victory!” I panicked and ran like a crazy person to find my laptop, heart rapidly beating at the thought we were stopped by some activist judge, only to find the truth with logic and reason. Now I’ll be able to sleep tonight! Thanks!

    I also assume that that would have been applied to the “200” around the country to determine who got let in, and who got kicked back out.
    A PROTEST seems to me to have NOT been called for, and surplus to the requirement of Immigration Officers to check documents, as they do every day.

      There is a provision in the EO that would allow for visas to be issued to people on a case by case basis.
      Couldn’t this provision be used to allow the travelers in if they have documents ? In other words, once they landed they will be reviewed individually or case by case
      basis.

      (g) Notwithstanding a suspension pursuant to subsection (c) of this section or pursuant to a Presidential proclamation described in subsection (e) of this section, the Secretaries of State and Homeland Security may, on a case-by-case basis, and when in the national interest, issue visas or other immigration benefits to nationals of countries for which visas and benefits are otherwise blocked.

      The ACLU knows who to ‘shop’ their motions to. Connelly’s #1 on their list of ‘friendly judges’.Of course she’s a fool and a clown. She’s an Obama appointee, a recent one.

      Not to worry. Pres. Trump’s naming his Supremes pick this week. He/she will be confirmed within a month, and sitting ON the Court. Where all roads-including this short-cut by Donnelly-inevitably lead.

It seems reasonable to me to allow those passengers travelling with valid visa’s and who were in the air when the EO was signed to be allowed entry into the U.S. – to deny entry seems unfair and counterproductive – imagine obtaining a valid visa for travel to the U.S. only to be turned backed on arrival after paying for an expensive ticket.

    It is unfortunate that this situation arose in the first place because it could have been avoided and I don’t think it helps President Trump that major protests broke out at major airports. All this does is make President Trump look like a bully while engendering sympathy for Muslims.

    All visas issued have a expiry date iirc.
    I read somewhere that 40% of illegals in the U.S. were here on visas and did not leave.

    Some countries I traveled fined you for every day overstayed. No money, then jail then deported.

    I think all people coming in on visas should be photographed, fingerprinted, and put in a national database. If caught overstating, fined, and deported.

    No EO needed just state department visa rules added. Vetting if needed.

    As Sundance pointed out, the judge did not rule on the legality of the executive order, it is perfectly legal. The press is gleefully hyperventilating over the “defeat of that bigot” Trump, such is their hatred.

    8 USC § 1182(f) Suspension of entry or imposition of restrictions by President

    Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.
