Officer Brian Rice has been acquitted of all charges by Baltimore Judge Barry Williams (full ruling pdf embed below).  Rice is the third of four officers accused to have been acquitted of all charges; the fourth, officer Porter, ended with a mistrial:

Baltimore State Attorney Marilyn Mosby has now tried four of the six Baltimore officers and, as further evidence of the ridiculousness of her attempts, she has not been able to achieve any convictions.

BALTIMORE SUN – Prosecutors in Baltimore have failed for the fourth time to secure a conviction in the Freddie Gray case, with Circuit Judge Barry G. Williams acquitting Lt. Brian Rice of all charges related to Gray’s arrest and death.

Williams cleared Rice, 42, of involuntary manslaughter, reckless endangerment and misconduct in office in a downtown Baltimore courtroom on Monday morning. The judge had dismissed a second-degree assault charge at the trial’s midpoint, and prosecutors dropped a second misconduct charge at the start.

Rice selected a bench trial rather than a jury trial, putting his legal fate in Williams’ hands. He was the fourth of six officers charged in the case to go to trial.

Williams said prosecutors had failed to meet their burden of proving the charges beyond a reasonable doubt, instead asking the court to rely on “presumptions or assumptions” — something it cannot do. He said the court “cannot be swayed by sympathy, prejudice or public opinion.”

Based on the law, he said, the prosecution failed to prove the elements of the crimes. (read more)

    Who is going to represent the taxpayers of Baltimore and file a lawsuit against Mosby, BLM, and BGI that turned the City upside-down?

        They definitely should drop the retrial of the officer who had 11-1 jury vote for acquittal. It’s obvious Mopsey has no credible cases and is just throwing spaghetti against the wall hoping something sticks so she can save a little of her ugly,pouty face.

      The taxpayers are going to be screwed in this again. They’ll be funding a lot of judgements against Baltimore and the DA’s office. I would bet all six of these police file lawsuits at some point (if they haven’t already), and the payouts will be big.

    The Governor’s office suggested she pack it in today, as did the newspaper, so if she’s been looking for someone else to blame when dropping the charges, she now has her excuse.

      I’d be surprised if she packs it in now. She has gone out on a limb on this. The left staked their whole anti-police rhetoric on her ability to publicly castrate the police officers. She can’t back down now. The great thing about being a demonrat is never having to say you were wrong.

    George Washington University School of Law professor John F. Banzhaf has filed a disciplinary complaint with the Attorney Grievance Commission of Maryland against Baltimore State’s Attorney Marilyn Mosby. The complaint seeks the disbarment of Mosby for her conduct regarding the investigation and prosecution the six police officers for the death of Freddie Gray.

      I’m a little confused. A July 18 Washington Times article said that Banzhaf would file the complaint on Tuesday, which would be today. But did he already file one back in June?

        The complaint above is the old one from June. Banzhaf is filing, or has filed, a new complaint. I haven’t seen it yet.

        July 19: An activist law professor calling for Baltimore State’s Attorney Marilyn J. Mosby to be disbarred over her prosecution of six Baltimore police officers in the arrest and death of Freddie Gray has now taken aim at the two deputy state’s attorneys who have argued the cases in court.

        John F. Banzhaf III, a public interest law professor at George Washington University known for filing lawsuits in high-profile court cases, said he planned to file two new complaints with the Maryland Attorney Grievance Commission on Tuesday calling for the disbarment of Chief Deputy State’s Attorney Michael Schatzow and Deputy State’s Attorney Janice Bledsoe. He filed a similar complaint calling on the commission to disbar Mosby last month.

        Banzhaf said the new complaints are based in part on Circuit Judge Barry G. Williams’ acquittal on Monday of a third officer, Lt. Brian Rice, of all charges in the case. They are also based on Williams having previously acquitted two other officers, Edward Nero and Caesar Goodson Jr., in May and June, respectively. […]

    The Baltimorons who run the city just went and gave the criminal’s family 6.5 million dollars for what? No convictions so no case. Like all liberals they love to spend everyone else’s money.

      Can the citizens of Baltimore sue the people who made the decision to pay that settlement? $6.5 million would have gone a long way toward repairing roads, improving utilities, etc.
