DOJ: No Contempt Charges For IRS Regional Head Lois Lerner…

simple message - lois lernerWASHINGTON DC – The U.S. Attorney’s Office for the District of Columbia will not seek contempt charges against former Internal Revenue Service official Lois Lerner for her refusal to testify before Congress, the Justice Department (DOJ) announced Wednesday.

It has been nearly a year since the House voted to hold Lerner in contempt in a mostly party-line vote. At the time, the charges were referred to the local U.S. attorney. The Justice Department officially informed House Speaker John Boehner, R-Ohio, of U.S. Attorney Ronald Machen’s decision in a letter sent to Boehner’s office Tuesday.

“A team of experienced career prosecutors in the U.S. Attorney’s Office was assigned to carefully assess the referral. After extensive analysis, the team concluded that the House Committee followed proper procedures in notifying Ms. Lerner that it had rejected her claim of a Fifth Amendment privilege and gave her an adequate opportunity to answer the Committee’s questions,” the Justice Department said in a statement. “However, the team also concluded that Ms. Lerner did not waive her Fifth Amendment privilege by making general claims of innocence. The Constitution would provide Ms. Lerner with an absolute defense if she were prosecuted for contempt.” (link)

        It is like having Al Capone as AG. The DOJ is corrupted. It should not be allowed to be in charge of criminal or civil prosecutions. This system is broken beyond repair at this point. Special prosecutors are needed.b We want many, many, arresses.

        Issa has dithered around for years. They should have given her and anyone else use immunity to catch the bigger fish. The fact they do not show they are not interested in catching them. Simple as that. The GOP joke on us continues. Gowdy is going to call the big fish first in his hearing. He knows better than this.

          I too am worried about Trey Gowdy. It was easy to figure out Boehner wanted him boxed in, thus the job on Benghazi to sideline Gowdy. Rep Cummings is a big ugly black joke in his defense of all things Hillary, yet he and his party have done wonders in their protection for those they wish to help.

          Unless Gowdy gets Hillary under oath and in the lights of national media, she will skate and he will be left sweeping the dirty floor where the secrets will fall. Boehner will smile that snarky smile knowing he made a sharp decision for him but not for our country: He could have move all these issues via his podium by putting media pressure…a coward for sure, perhaps an accomplice for others.

          Of lot of real talent is going into the dumpster. We citizens are the real losers.

          I wonder how Americans would react if our muslim enemies did in fact do serious damage with great loss of life (a lot of national politicians) in Washington, DC. Would we cry out in the open for such a tragedy, while in private we suggest “new leadership” is the gift we give ourselves to “right the ship of state” we need?

          Instead of electing a very competent leader we seem to be focused on “women’s rights” and now is the time to elect a woman based on this wish…some priorities we make when war is just around the corner!

          Let’s invite some Iranians over for a barbacue; ask them to bring the starter fluid!

        Where is the great Trey Gowdy. How are all these investigations being swept under the rug. It takes more than talk to catch a thief Trey. Some one got your hands tied. Oh that’s right your all busy supporting amnesty to bring thousands of kids in here from Central America and it will be a proud day when you guys confirm the first black AG Loretta Lynch who will assure that no other investigations get anywhere. Lois Lerner pulled it off and Hil will do the same and don’t forget Obama’s executive orders. The GOP is getting walked all over. Sure glad I voted for them….not.

Make no mistake about it, if you object to the Obama Administration’s lawlessness BUT you didn’t vote him out of office, then YOU VOTED FOR HIM!

      Bottom line folks: whoever the Republican nominee is, get off your high horses and vote for the Republican. If you don’t, then you are voting for this lawlessness to continue, Nobody is perfect! Hold your nose, put lipstick on that pig, do whatever you have to do to FORCE yourself to vote Republican!!!!!

    I’m wondering if one of the crack researchers here know if there’s a statute of limitations on contempt of Congress charges? Not that it would happen, but I’d like this to be revisited on January, 20 2017.

      Under Statutory Criminal Contempt.
      U.S.C. §194 establishes the procedure to be followed by the House or Senate if it chooses to refer a recalcitrant witness to the courts for criminal prosecution rather than try him at the bar of the House or Senate. Under the procedure outlined in Section 194,142 “the following steps precede judicial proceedings under [the statute]: (1) approval by committee;143 (2) calling up and reading the committee report on the floor; (3) either (if Congress is in session) House approval of a resolution authorizing the Speaker to certify the report to the U.S. Attorney for prosecution, or (if Congress is not in session) an independent determination by the Speaker to certify the report;144 [and] (4) certification by the Speaker to the appropriate U.S. Attorney for prosecution.

      Translation: it is within the power of the Congress to bypass DOJ discretion. Congress can force the issue.

        Sorry left off the jury part. My bad.

        It seems quite apparent that Congress intended to leave no measure of discretion to either the Speaker of the House or the President of the Senate, under such circumstances, but made the certification of facts to the district attorney a mandatory proceeding, and it left no discretion with the district attorney as to what he should do about it. He is required, under the language of the statute, to submit the facts to the grand jury.

    This creates quite a predicament. I wonder how AG would treat this if they offered her immunity and she still refused to testify… If they refused to prosecute her for contempt in that situation I think all you know what would break loose.

    The House has the legal authority to have the Sergeant at Arms arrest her but that would require a Speaker with a backbone at least as strong as that found in a nematode.

    Corruption, filth, lies, and treason…democrats (and some republicans) on parade. When the hammer falls, the economy tanks, ISIS and Iran succeed in pulling off a terrorist attack in our country of horrific proportions, and our nation wakes up to the fact that their government has worked towards their destruction, there will be rivers of blood. Lerner and many will be hunted down.
