update-1BREAKING NEWS – It is being widely reported that at 3:30pm (EST) today at Fort Bragg North Carolina an announcement will be made as to the status of Bowe Bergdahl and what charges, if any, he will face.

UPDATE: BREAKING LEAK – Bergdahl will be charged with two criminal charges: #1 Desertion, #2 Misbehavior before the Enemy.

♦  The first charge “Desertion” is remarkably different from AWOL.  “Desertion” implies specific evidence to prove the soldier charged intended to stay with the enemy.

♦  The second charge “Misbehavior before the enemy” has several aspects:  • Running away • Abandoning or surrendering command • Putting safety of command in danger • Throwing down arms  • Conduct that is cowardly  (more here)

    • What is apprently not understood here is the last part, where it says , “Army Forces Command Gen. Robert B. Abrams ordered that Bergdahl, now the subject of the Serial podcast, face a court-martial for desertion.” BUT it also says that it will be a SPECIAL COURTS-MARTIAL, and that the MAXIMUM penalty will be ONE YEAR IN CONFINEMENT! A very far cry from death by a firing squad.

        @Sundance: The Iran Nuke Deal is somewhat similar to obamacare and Pelosi who said “we have to pass it to find out what’s in it!”. State Department yesterday said “No details will be made available before agreed, signed and delivered!” Psaki additionally stated there maybe be no revealing any detail at all anytime unless the white house changes their mind and decides to reveal them. For the time being nothing will be revealed.

      Yes, it does. If the head of FORSCOM says to charge him, they aren’t playing. Military judges are military first, Bergdahl isn’t getting away with this any longer. I hope they try him at Bragg and not in Texas. It’s a PITA for the host post/facility.

        A jury of his peers, company grade NCOs/enlisted, or Company grade officers. All should have had combat experience. Unless the Army bows to PC pressure. The Military Judge, Ltc/Col. I suspect Col will be the rank for the judge.

        I saw this interview live as well and not only did Brooke suggest that his Taliban captivity was punishment enough for his crimes, one of the guest suggested that the Army may have to be blamed for part of this situation. It was suggested that his commanding officer should have noticed the signs (ie., Bergdahl’s previous AWOL situation) that Bergdahl’s mental health was in question and that the Army should have taken him off the front lines. Fighting terrorists in Afghanistan is a high pressure dangerous job and all the soldiers are mentally stressed, that’s a given, but not all of them decide to send their personal belongings back home and decide to voluntarily walk off the base and make contact with the enemy to engage in an ideological dialogue.

Several reports today stated that Bergdahl may not even come to trial until Obama’s terms is over because of the mounds of paperwork and evidence which must be sorted through by Bergdahl’s defense team. Twelve hundred pages of testimony. We could come up with that on a daily basis were we to bring a case of impeachment against Obama.

We are now officially the Iranian militia Air Force. US bombers will now conduct airs strikes in Tikrit to help the stalled attempts to retake the city. Remember 2 weeks ago the MSM was jumping for joy highlighting this as proof that US troops weren’t needed to defeat ISIS. The administration can now no longer credibly state that they are not working with Iran in Iraq.

    I just watched CNN video about POW Bergdahl being charged with desertion. Hello he was not a POW he deserted his post. They even read statements of how Berghdal was treated. I could care less how he was treated…he deserved what he got when he walked off of the post.
