First, it should be recognized that Team Hillary is trying to hide this explosive revelation in the media cycle of the wildly covered Benjamin Netanyahu speech.

Accepting the timing of the story, if you needed further confirmation of how horridly corrupt the Machiavellian schemes are within Team Clinton, well, this latest story represents the “cherry” on the cake.

Remember too, this current revelation must be kept in perspective because it comes on the heels of some other rather conspicuous previous sunlight encumbrances.  Namely the November 2012 Thanksgiving holiday when a mysterious fire took place in the State Department DC office building.  Well, actually directly above her exact office – cause undetermined.

A “fire” which preceded an unfortunate slip and fall for the Secretary, resulting in a concussion, which led to the discovery of a blood clot, that ultimately delayed her congressional testimony before a Senate Hearing into the events of Benghazi two months earlier.

And this latest revelation must also keep in mind an internal State Department Accountability Review Board report where they never actually interviewed Hillary but said they reviewed “all pertinent documents”.  Did those ARB investigators even know about her personal email?   I digress….

hillary strokeThe potential FOIA ramifications are boundless. The timing of the notification is virtually simultaneous to another Secret Email Account currently under judicial scrutiny within the EPA again as a result of FOIA avoidance. First to Hillary.

The report tonight from The New York Times reveals that during Hillary Clinton’s entire tenure as Secretary of State, she used only a private email account to conduct official business and those emails were not stored on government servers.

[…] Her expansive use of the private account was alarming to current and former National Archives and Records Administration officials and government watchdogs, who called it a serious breach. (link)

The New York Times report says at no point did Clinton hold a government email address while heading up the State Department. How rare is this? As one former director of litigation at the National Archives said:

“It is very difficult to conceive of a scenario — short of nuclear winter — where an agency would be justified in allowing its cabinet-level-head officer to solely use a private email communications channel for the conduct of government business.”

According to the Times report – Clinton did end up handing over her emails to the government, but only two months ago, and the Times specifically notes her advisers “decided which ones to turn over to the State Department.” All of this, not incidentally, might well be in violation of federal requirements on government agency correspondence.

According to Nick Merrill, a Clinton spokesman, her personal email account was used intending to follow the “letter and the spirit of the rules.”

[…] Mr. Merrill said that because Mrs. Clinton had been sending emails to other State Department officials at their government accounts, she had “every expectation they would be retained.” Mr. Merrill declined to answer questions about any emails that Mrs. Clinton may have sent to foreign leaders, people in the private sector or government officials outside the State Department.

Hey wait, what…. where did we recently read that exact same justification?

Ah yes, the recent Landmark Legal Foundation v. The United States EPA FOIA case – where it was argued in court the reason for FOIA problems -lack of legal delivery- was caused by personal email accounts being used in lieu of the required government accounts.

Apparently the Obama administration, at least the Cabinet Officers, has a habit of using personal email as a technique to avoid the sunlight of their activity.

Back to Hillary. How exactly did this latest revelation reach the news cycle:

[…] The existence of Mrs. Clinton’s personal email account was discovered as a House committee investigating the attack on the American Consulate in Benghazi sought correspondence between Mrs. Clinton and her aides about the attack.

Two weeks ago, Mrs. Clinton provided the committee with about 300 emails — amounting to roughly 900 pages — about the Benghazi attacks that Mrs. Clinton’s aides had found among her personal emails.

Mrs. Clinton and the committee declined to comment on the contents of the emails or whether they will be made public.

update-1UPDATE: (Via Washington Post) In March 2013, an adviser to Clinton, Sidney Blumenthal, had his email hacked by “Guccifer” — the Romanian hacker perhaps best known for revealing George W. Bush’s paintings to the world. At the time, Gawker reported that Blumenthal was communicating with an account that appeared to belong to Clinton at the “clintonemail.com” domain. The content of some of those emails was published by RT.com.

Examining the registry information for “clintonemail.com” reveals that the domain was first created on January 13, 2009 — one week before President Obama was sworn into office, and the same day that Clinton’s confirmation hearings began before the Senate.
