James Holmes, wide-eyed and unshaven, his head bobbing slightly, appeared not to speak during the brief hearing. He will be formally charged next Monday.
Authorities say the 24-year-old former graduate student is refusing to cooperate, and it could take months to learn what prompted one of the worst mass shootings in U.S. history.
A prosecutor said her office is considering pursuing the death penalty. Eighteenth Judicial District Attorney Carol Chambers said a decision will be made in consultation with victims’ families.
Holmes has been held in solitary confinement since the shooting. He is being held on suspicion of first-degree murder, and he could face additional counts of aggravated assault and weapons violations.
Holmes began buying guns nearly two months before the shooting and recently bought 6,000 rounds of ammunition over the Internet, Aurora Police Chief Dan Oates said.
During the attack, Holmes allegedly set off gas canisters and used a semiautomatic rifle, a shotgun and a pistol to open fire, Oates said.
The semiautomatic assault rifle jammed during the attack, forcing the gunman to switch to another gun with less firepower, a federal law enforcement official told The Associated Press. That malfunction and weapons switch might have saved some lives.

It is so much easier to believe that someone is sick, than to accept that some people just want to be destructive. The ends that they go to achieve that is can be horrendous, but without some sort of anchor in life, it will continue to happen.
In my lifetime I have seen the attempted destruction of religion, family values, American exceptionalism, and all in the name of equality, of tolerance, to the detriment of everything else.
Our President lectures us that we are nothing without government. In Florida we have a young man who should spend the rest of life in jail because he got out the car, while trying to protect his neighborhood. At the very least, after he got out of the car, he should take a beating because he broke the rules. In Kentucky we have a young woman who is facing charges after the people who abused twice, once sexually and then by showing the self-gratifying pictures to everyone, for having the temerity to complain after her abusers are given a sweetheart deal.
This is just recent events, I could go on and on like the people who are complaining about sanctions given to a football program because of their lack of due diligence in stopping a child molester. In Chicago there have been 24 murders this month twice the amount of Aurora but that is not as important because it might make the AA community look bad.
It has become a me, me world. Self-gratification at any cost. What about the fans and the players? Well what about the kids? If he didn’t get out of the car? Well, what if the other person had just gone on home, or not attacked. We need to find our anchors again, belief in God, self reliancy, accountability for our actions and stop looking for answers where there are none.

As rational folks, we can’t understand how someone can be this sinister. People with severe schizophrenia can’t determine what is real, what isn’t, and in the end it will come out that this gentleman suffers from severe paranoid schizophrenia. It fits….he was considered brilliant – which many schizophrenics are, he had totally cut himself off from the world, including dropping out of his PHd program.

Agree, tragic, because often families are knowledgeable and try to intervene but the laws are against families having any say in compelling mental ill and service resistant people into medical treatment. It is a national disgrace that there is so little balance between individual rights and public safety regarding mental illness.
Not only is mental illness poorly managed in our medical system, but early detection and intervention is not available in our institutions. Families are systemically excluded once the person is deemed an adult at 18 years old.
See I disagree, I think he’s evil and people can’t deal with that so they want to believe someone can’t be that evil so they need them to be insane, sick, etc.
Take for instance alcoholism, I believe people get addicted to alcohol, but when they do cruel things when they’re drunk, imo it isn’t because of the alcohol, it’s because they’re already cruel and the alcohol gives them the courage to act out their cruelty.
I also came away with a different opinion on his reaction in court. He looked to me like someone who was having a hard time staying awake. Once again people want to see some kind of mental illness, so they’ll anything to make it appear he’s sick, because the alternative is too hard too understand.
He probably does have mental problems, but he took a while to plan this crime, and he knows that what he did was evil and wrong. Fortunately, not every schizophrenic kills people. I do not want him to be judge innocent by reason of insanity because – you know what? – he’ll get out some day. They’re trying to let John Hinckley out, and will probably succeed.
From what I’ve heard different attorneys say that in Colorado if you’re found to be insane, you go to a mental hospital and as soon as you’re deemed to no longer be insane, you’re free, whether that’s 2 months or 2 years. Other states once you’re deemed sane or sane due to medication then you go to prison. So if this is true and he’s acting, then he could be out in a few months.
I don’t see a jury finding him insane though and would be surprised if he doesn’t get the death penalty.
I head an attorney state today that Colorado doesn’t have an insanity defense. If you are convicted and you require treatment, you’ll be treated at a mental facility but as soon as you’re deemed well enough to go to a regular prison you’ll go there to finish your sentence. In other words, Holmes might be lucky enough to spend part of his time at a mental facility, but he won’t be there permanently.
If he goes to a regular prison, even if he’s put in protective custody, I’m sure some inmate is going to kill him. In fact, not getting the death penalty will probably result in a quicker death than getting DP.

Has anyone looked at a typical Weekend Death Toll in Chicago? Well, it usually hovers around 7-12 dead and 40-50 wounded. Not to make like at all of what happened in Colorado, isn’t there a bit of irony here? Hello? Chicago, home of the toughest gun laws in America? Where is Obama on that “carnage”?

I have a question. Why is it ok for all the people in Colorado to say it was god plan but not ok for Zimm to say it. They all seemed to forgive that freak. Sorry if I was over the line but out of all the interviews I saw almost everyone referenced god.
I am from Aurora…3 blocks from the shooting…and I believe GZ when he says it was gods plan and that he is innocent. However most people here in Aurora aren’t hateful bastards like it seems Team Skittles is. We are a very religious community as well. Almost everyone I know here says they believe in God and more then I thought go to church on Sundays. We lean more Liberal than Conservative here because of Boulder and the surrounding areas that are flowing over into Denver and spreading. If you go outside of the metro Area there are many many conservatives out there in the farmlands and up in the mountains…sadly rural areas hold less people. We have CU up in Boulder and now in Denver, its a VERY liberal college and I hate that so much. I truly believe this was all Gods plan. JH’s gun jammed… sparring more lives…The police stations were a block and a block and a half away making it so they could get there before he made it out to the main lobby where he was headed…he saw the cops and headed back to his car. Aurora and Colorado in general are great places to live. The only real bad neighborhood around here is Montghetto (Montbello) where most of the real thugs and gangsters live. There are bad areas of Aurora and Denver but for the most part we look after each other and watch each others back. We are religious and fun and loving. Even those who don’t go to church out here…most of them believe in God. I love my State and I love my City. I will continue to go to THAT movie theater if they reopen it and look forward to the Hobbit and Les Mis midnight showings there. Thank God I was to broke to go to Batman…though I am posative I would have gotten out physically fine. (I would have been in theater 8. Found that one out.)

Has anyone noticed how many of these shooters come out of recent university programs? The question is always asked, “Didn’t anyone notice anything aberrant or strange in his behavior?” The answer is always, “Well, he was strange…” or “…acted weird…” or “…was tossed out of class…” or “…kept to himself…”.
There seems to be a conscious outcry – to get answers – as to ‘why’ someone didn’t DO SOMETHING about these folks before they went over the edge.

Now, they are running off the track in a society that has few societal or behavioral controls.
Now, amidst all this, a professor, teacher or colleague is supposed to DO WHAT? Report aberrant or “abnormal” behavior in a milieu that doesn’t even acknowledge the existence of abnormal?

I agree with most of what you said…but honestly what can be done? They can’t be arrested for acting strange. They can’t be arrested for being a loner. They can’t be arrested for talking to fire hydrants. Hell they can’t even do anything if you tossed out of class. No crime has been committed and if they can act sane enough for long enough they can pass any psych evaluation.

I agree SDC. As someone who has a close family member with schizophrenia – not violent and had it for 40+ years – I personally am confused as to how cultural marxism works here. Approximately 1% of the US population has schizophrenia. Are we going to lock all of them up because one thousandth of a percent of that 1% goes completely off the ranch like Woody in Aurora? There are difficulties from a family perspective once someone with schizophrenia hits 18. Even if they need help and the family is begging authorities for it, they will not help unless that person on their own free will decides they need to be taken to a ward.

Is it possible that James had an accomplice and the phone call was the cue to open the door ?

Read somewhere earlier today that, due to his enrollment in the doctoral program, he was on the receiving end of a stipend in excess of $20,000…by quite a bit. Don’t remember the details.
OK, I just looked that up, and sure enough the University is saying that he received a stipend of $26k per year. I’m guessing that’s his pay as a research assistant. I was a teaching assistant. I was paid monthly though, I didn’t receive the stipend as a lump sum. Maybe he just saved up most of what he was paid?
Or, he got a few of those unsolicited credit cards that are often sent to college students.

I don’t think he was planning on getting caught. He probably thought that the diversion at the apartment would give him enough time to do what he wanted and then get lost in the confusion.
He purchased 6000 bullets…he couldn’t fit that much in a couple clips if he tried. Oh no…he wasn’t done. He didn’t want to die hence the ballistics gear. He wanted to kill as many as he could here…have his apartment building go up in flames so the cops would be there (he knew there were police stations near the century…hell the jail is a block and a half away and everyone know it). While the police were at his apartment building he would go through all four theaters showing the premier and then take off to continue his rampage else where.
Instead the bombs didn’t go off at his place, the lady never went in his apartment. Therefore the police were still close enough to get there in a minute and a half. As he made his way to the lobby (in between the four theaters showing the movie. Remember I have been in this theater many times I know the layout like the back of my hand) he saw the cops…bolted back through theater 9 to his car only to be caught there. With 200 cops around you aren’t gonna escape. He’s a coward who didn’t want to die. So he surrendered and told the cops about the booby traps to try and get them killed.
I do believe he was far from done.
Looked up Colorado law on insanity defense. It can be used and they do go to mental institution and released only by the courts after an examination.
At least not being an attorney that is what I take it to say.

The release hearing shall be to the court or, on demand by the defendant, to a jury composed of not more than six persons. At the release hearing, if any evidence that the defendant does not meet the release criteria is introduced, the defendant has the burden of proving by a preponderance of the evidence that the defendant has no abnormal mental condition which would be likely to cause him or her to be dangerous either to himself or herself or to others or to the community in the reasonably foreseeable future. This paragraph (b) shall apply to offenses committed on and after July 1, 1995.
I think he really is insane. That said, once your illness causes you to hurt so many people you need to be put down. Lots of people have serious issues and manage to hold themselves back from hurting others. They only hurt themselves.
